未享受基本养老保险待遇人员能否认定工伤

【摘要】:正案情简介■贾某,女,出生日期为1958年1月2日,于2010年5月13日在某物业公司工作时摔伤。2011年5月,贾某向人社局提交工伤认定申请。人社局经审查,认为贾某发生事故时已超过法定退休年龄,与用人单位不构成劳动关系,不属于《工伤保险条例》调整范围,决定不予受理工伤认定申请。贾某不服,向法院提起行政诉讼。法院审理后认为,人社局不能依据职工是否超过法定退休年龄作为能否受理的条件,而是应当以是否享受基本养老保险待遇作为能否受理的判断标准,并据此向人社局发出《司法建议书》。人社局遂自行撤销了不予受理决定书并重新审理。争议焦点■超过法定退休年龄且未享受基本养老保险待遇人员是否属于《工伤保险条例》调整的对象?
[Abstract]:Jia, a female, was born on January 2, 1958, and was injured while working in a property company on May 13, 2010. In May 2011, Jia submitted an application for industrial injury determination to the Social Bureau. After examination, people and society bureau thinks Jia Mou has exceeded legal retirement age when occurrence accident, and unit of choose and employ persons does not constitute labor relation, do not belong to "inductrial injury insurance regulation" adjust scope, decide not to accept inductrial injury cognizance application. Jia Mou disagrees, bring administrative suit to court. After hearing the case, the court held that the Bureau of people's and Social Affairs could not rely on whether the worker exceeded the legal retirement age as a condition for admissibility, but should take whether or not to enjoy the basic old-age insurance treatment as the criterion of admissibility. Accordingly, the judicial recommendation was issued to the Bureau of Human and Social Affairs. The Bureau of Human and Social Affairs, on its own initiative, dismissed the decision on inadmissibility and retried it. Does dispute focus exceed legal retirement age and do not enjoy basic endowment insurance treatment personnel whether belong to "inductrial injury insurance byelaw" adjust the object?
