经济补偿金的法律定性及制度完善

【摘要】:经济补偿金制度作为劳动立法中的一项重要制度设计,通过倾斜保护相对弱势的劳动者以修正用人单位和劳动者之间的力量差异、进而形成实质平衡的利益格局。这项制度并不是“普适”的,而是有着特定的适用范围。经济补偿金相对于用人单位来说是法定义务,相对劳动者来说是法定权利。 我国的经济补偿金立法虽然起步不算早,但对于稳定用人单位与劳动者之间的劳动关系、保障劳动者的合法权益起到了极其重要的作用,具有制约和补偿的功能。就其性质而言,我国的经济补偿金具有用人单位帮助的义务化或法定化的性质,与劳动法上的赔偿金、违约金相区别。同时具有单向性、法定性、有限性和公平性的特征。我国现行劳动法律丰富了经济补偿金的适用范围,将劳动合同解除和终止均纳入其中;在支付标准方面除了对高收入劳动者进行了双重限制外,一般没有封顶规定。同时,我们也应看到现行经济补偿金制度存在的问题,进行一定的调整和完善是必要的。根据比较分析我国与国外经济补偿金的性质、适用范围和支付标准,我国现行经济补偿金的制定标准过高,存在种种弊端。应根据经济补偿金的性质,扩大经济补偿金的适用范围,限定经济补偿金的水平。将合同期限制度引入经济补偿金制度中,根据劳动岗位本身的特点确定劳动合同的期限,对劳动合同的解除和终止给予经济补偿金,但其中对固定期限劳动合同的终止则不予补偿,适当减轻用人单位的用工负担,在倾斜保护劳动者的基础之上平衡劳资关系。
[Abstract]:As an important system design in labor legislation, the system of economic compensation is designed to protect the relatively weak workers in order to correct the differences between employers and workers, and then form a substantial balance of interests pattern. This system is not universal, but has a specific scope of application. Economic compensation is the legal obligation relative to the employer and the legal right to the laborer. Although the legislation of economic compensation in our country is not too early to start, it plays an extremely important role in stabilizing the labor relations between employers and workers and protecting the legitimate rights and interests of workers, and has the function of restriction and compensation. As far as its nature is concerned, the economic compensation of our country has the nature of the unit of choose and employ persons to help the obligation or legalization, and the compensation in labor law, the penalty for breach of contract is different. At the same time, it has the characteristics of unidirectionality, legality, finiteness and fairness. The current labor law of our country enriches the scope of application of economic compensation, which includes both termination and termination of labor contract. In addition to double restrictions on high-income workers, there is no ceiling regulation in general. At the same time, we should also see the existing problems in the current economic compensation system, it is necessary to adjust and perfect it. According to the comparative analysis of the nature, scope of application and payment standard of economic compensation between China and foreign countries, the current standard of economic compensation in our country is too high and there are many disadvantages. According to the nature of economic compensation, the scope of application of economic compensation should be expanded and the level of economic compensation should be limited. Introducing the contract term system into the economic compensation system, determining the term of the labor contract according to the characteristics of the post itself, and granting economic compensation for the termination and termination of the labor contract, However, the termination of fixed term labor contract should not be compensated, the burden of employing unit should be lightened properly, and the labor relations should be balanced on the basis of the protection of workers.
