WTO影响下劳工权益保护与国际贸易的法律规制

【摘要】: 国际贸易与劳工权益保护相联系的问题是一个十分复杂的问题,它涉及到国际国内、经济社会、政治各个方面,在世界各国经济社会差异较大的形式下,关于国际贸易中劳工权益保护水平问题的解决,将是一个长期的博奕的过程,各国基于自身利益的考虑必然会采取各不相同的立场,但在这个长期的过程中,国际贸易中的劳工权益保护水平在每一个阶段必然会呈现出适应该阶段的特点。在今后的时间,国际贸易与劳工权益的关系问题将继续受到各个国家、区域性国际组织以及全球性组织的关注。中国已全面进入了国际主流社会,市场的全面开放必然导致资本、信息、劳动力的全球流动,它要求我们的法律制度要与国际条约、国际惯例接轨。这就凸显出劳动法在一些方面的规范己经不能适应社会发展的要求,特别是加入WTO带来的与国际劳工权益保护的接轨和衔接问题,因此,参照国际劳动立法建立健全我国劳动标准体系是一项重大而急迫的任务。 本文共分为四章。第一章以“国际劳工标准”入手,分析了“国际核心劳工标准”这一全文的核心概念的涵义;第二章首先通过对劳工权益保护这一概念的阐述,分析了当今国际劳工权益保护水平与国际贸易间的关系,指出了两者并不是简单的促进或者阻碍的关系,而是在经济社会的大环境下相互作用、相互影响;其次阐述了当今国际社会对国际贸易中劳工权益保护的立法和实践,从发达国家的国内立法、国际双边和区域贸易协定、非政府组织有关劳工保护的各种标准认证和国际组织中有关劳工权益保护的文件几个方面进行陈述;最后,对国际社会对劳工权益保护水平的未来发展趋势进行了预测;第三章重点分析了当前我国劳工权益保护水平与国际劳工标准的差距所在,我国的劳工法律规制的现状表现出立法和国际劳工标准的差距以及劳工执法过程中执法上的漏洞和不足之处;第四章从我国实际情况出发,通过借鉴上一章分析的结果--查找出差距所在,从而提出了我国应采取的对策,分为法律的规制以及其他方面措施的实施,从而使我国的劳工权益保护法律规制更好的与国际贸易的需要和国际劳工标准的要求相接轨。
[Abstract]:The connection between international trade and the protection of labor rights and interests is a very complex problem. It involves all aspects of international and domestic, economic and social, and political, and in the form of greater economic and social differences among countries in the world. The solution to the problem of the level of labor rights and interests protection in international trade will be a long-term game process. Countries will inevitably take different positions on the basis of their own interests, but in this long-term process, The level of protection of labor rights and interests in international trade is bound to adapt to this stage in each stage. In the future, the relationship between international trade and labor rights and interests will continue to be of concern to countries, regional international organizations and global organizations. China has entered the international mainstream society in an all-round way, and the overall opening of the market will inevitably lead to the global mobility of capital, information and labor force. It requires our legal system to be in line with international treaties and international practices. This highlights the fact that some aspects of labor law norms have been unable to meet the requirements of social development, especially the problems of convergence and convergence with the protection of international labour rights and interests brought about by China's entry into the WTO. It is an important and urgent task to establish and perfect China's labor standard system with reference to international labor legislation. This paper is divided into four chapters. The first chapter begins with "International Labor Standards" and analyzes the meaning of the core concept of "International Core Labor Standards". This paper analyzes the relationship between the level of international labor rights and interests protection and international trade, and points out that the relationship between them is not a simple promotion or hindrance, but interaction and interaction in the economic and social environment. Secondly, it expounds the legislation and practice of the international community to protect the labor rights and interests in international trade, from the domestic legislation of developed countries, the international bilateral and regional trade agreements, Several aspects of NGO certification on labor protection standards and documents on labour rights protection in international organizations are presented. Finally, the future development trend of the level of labour rights protection in the international community is forecasted. The third chapter focuses on the analysis of the gap between the current level of protection of labor rights and interests in China and international labour standards. The current situation of labor law regulation in China shows the gap between legislation and international labor standards, as well as the loopholes and deficiencies in the enforcement of labor law. Chapter four starts from the actual situation of our country. By using the results of the previous chapter to find out the gap, this paper puts forward the countermeasures that should be taken in our country, including the legal regulation and the implementation of other measures. Thus, the legal regulation of labor rights and interests protection in our country is better in line with the needs of international trade and the requirements of international labor standards.
