仲裁机构和人民法院不应主动审查仲裁时效

【摘要】：正在劳动争议司法实践中,劳动仲裁时效往往是当事人争议的一个焦点问题,对于仲裁时效法律适用的准确把握,不仅涉及到仲裁与诉讼的有效衔接,更决定了案件的审理方向和处理结果。仲裁时效作为一种抗辩事由,在一方当事人(主要是用人单位)提出的情况下,无论是仲裁机构还是人民法院均应当审查仲裁时效期间是否超过法律规定,此无争议。但对于当事人未提出仲裁时效抗辩的情况下,应否主动审查仲裁时效期间,仲裁机构与人民法院掌握标准并不统一,造成司法实践中比较混乱,有必要加以解决。
[Abstract]:In the judicial practice of labor dispute, the limitation of labor arbitration is often a focal point of the dispute between the parties. The accurate grasp of the application of the law of the limitation of arbitration not only involves the effective connection between arbitration and litigation. It also determines the trial direction and outcome of the case. There is no dispute that whether the period of limitation of arbitration is more than the legal stipulation should be examined by the arbitration institution or the people's court in the case of one party (mainly the employing unit) as a defense. However, if the parties do not raise the plea of limitation of arbitration, should they take the initiative to examine the period of limitation of arbitration, the standard of arbitration institution and people's court is not unified, which causes confusion in judicial practice, and it is necessary to solve it.
