合理定性与差别调整:被开除公职者的退休金调整规则

【摘要】：在退休金制度下,我国公职人员在职时无需缴纳养老保险费,正常退休时享受国家提供的退休金。因违法违纪被开除公职后其在公共部分累积的工龄被清除,即将退休或者已经退休的,不得再享受退休待遇。由惩戒机关在法律之外处分公职人员的退休金权利,不仅违反了宪法关于公民权利保障原则,破坏了惩戒法定原则,而且直接威胁到被开除者的老年生存。从本质上看,公职人员的退休金包含了其基本养老保险待遇和国家支付的退休福利,前者属于公民维持生存的财产权利,后者属于单位提供的退休福利。对此应当区别对待,公民维持生存的财产权依现行法律不得剥夺或者限制;退休福利在公职人员违法违纪时应予以收回,但应遵循法律保留原则。
[Abstract]:Under the pension system, public officials in our country do not have to pay for the pension insurance in service and enjoy the retirement pension provided by the state when they retire normally. The work age accumulated in the public part of the public sector has been cleared because of the violation of the law and discipline. The pension right of public officials not only violates the principle of the constitutional protection of civil rights, destroys the principle of disciplinary law, but also threatens the elderly survival of the expulsion. In essence, the retirement pension of public officials includes its basic pension insurance treatment and the retirement benefits paid by the state, the former belongs to the maintenance of the citizens. The property right, the latter belongs to the retirement welfare provided by the unit. It should be treated differently. The property rights of the citizens shall not be deprived or restricted in accordance with the current law; the retirement benefits should be retracted when the public servants violate the law and discipline, but should follow the principle of legal retention.
