论我国的罢工权立法

【摘要】:随着社会主义市场经济的发展和劳动者法律意识的增强,我国劳资关系进入了新的发展阶段,近几年我国的罢工现象时有发生,受到广泛的关注,已经成为不可回避的现实。在当前我国正致力于推动收入分配改革、尤其是在“提高劳动者报酬,让群众体面劳动”的背景下,罢工事件所蕴含的社会价值和劳动权利启示,无疑值得全社会重视。 在罢工权研究方面,国外对罢工权及其相关制度已经进行了许多深入的研究,罢工权在多数国家已被载入宪法,成为一项普遍性的社会经济权利,一些国家除了在宪法中规定罢工权外,还在法律法规中有具体的配套规定。我国学者对罢工权的研究已取得了一定成果,,但是目前对罢工权没有统一的定义,研究得也不够系统全面,缺乏罢工权立法的具体操作规范和与其他相关法律法规的配套衔接,导致在罢工事件中各方行动都无法可依,容易出现无序罢工和侵犯劳动者合法权益的情况,进而影响社会稳定,因此有必要对罢工权立法进行进一步的研究。 本文从罢工权的涵义出发,分析了罢工的类型和罢工权的属性,通过分析罢工权立法对政府、企业和劳动者的影响得出罢工权立法的必要性,对影响我国罢工权立法的因素进行了历史考察,发现其内在认知和外在制度环境两方面的原因,立足我国国情分析国外的相关立法,进而沿着这两条路径,研究罢工权立法的基本原则和具体限制,对确立和进一步完善我国罢工权立法提出了系统性的对策建议,这对现阶段罢工现象的司法实践有借鉴作用,对今后的立法完善亦有参考价值。
[Abstract]:With the development of socialist market economy and the strengthening of workers' legal consciousness, labor relations in our country have entered a new stage of development. In recent years, the phenomenon of strike has occurred frequently in our country, which has received extensive attention and has become an unavoidable reality. At present, our country is devoting itself to promoting the reform of income distribution, especially under the background of "increasing the remuneration of workers and making the masses work with dignity", the social value and the inspiration of labor rights contained in the strike event undoubtedly deserve the attention of the whole society. With regard to the study of the right to strike, many in-depth studies have been carried out abroad on the right to strike and its related systems. The right to strike has been enshrined in the constitutions of most countries and has become a universal social and economic right. In addition to the constitutional right to strike, some countries also have specific provisions in their laws and regulations. Some achievements have been made in the study of the right to strike by Chinese scholars, but at present there is no uniform definition of the right to strike, and the research is not systematic and comprehensive enough, lacking the specific operational norms of the legislation on the right to strike and the supporting link with other relevant laws and regulations. Therefore, it is necessary to further study the legislation of the right to strike, which leads to the disorderly strike and encroaching on the legitimate rights and interests of workers, which will affect the social stability. Starting from the meaning of the right to strike, this paper analyzes the types of strike and the attributes of the right to strike, and concludes the necessity of legislation on the right to strike by analyzing the influence of the legislation on the right to strike on the government, enterprises and workers. This paper makes a historical investigation on the factors affecting the legislation of the right to strike in China, finds out the causes of its internal cognition and external institutional environment, analyzes the relevant legislation abroad based on the national conditions of our country, and then follows these two paths. This paper studies the basic principles and specific restrictions of the legislation on the right to strike, and puts forward systematic countermeasures and suggestions to establish and further perfect the legislation of the right to strike in China, which is useful for reference to the judicial practice of the phenomenon of strike at this stage. Also has the reference value to the future legislation consummation.
