农村社会保障建设中集体与个人资金来源的法律思考

【摘要】：资金不足是当前农村社会保障建设的最大"瓶颈"。一直以来,政府对农村社会保障资金投入不足,而集体与个人的资金承担能力有限。资金紧张,导致当前农村社会保障建设进展缓慢。之所以会出现这种状况,主要有以下原因:首先是对农村社会保障认识存在误区;其次是相关的责任主体投入不足;最后是法律建设滞后。集体和农民承担部分资金,是权责一致的要求。集体资金来源要着重考虑:在《农村社会保障法》中规定可从集体企业利润中提取农保资金;完善《物权法》的相关规定从土地林地等收入中提取农保资金;修改《劳动法》规定雇主依法交纳社会保障资金。农民个人资金来源可着重考虑:完善《农村土地承包法》在征地中足额补偿农民;制定法规规章出台更多的惠农政策;制定《户籍法》改革户籍制度。
[Abstract]:The shortage of funds is the biggest "bottleneck" in the current rural social security construction. The government has been inadequately invested in the rural social security funds, and the capacity of the collective and individual funds is limited. The shortage of funds has led to the slow progress of the current rural social security construction. There are some misunderstandings in the understanding of the social security of the village; the second is that the related responsibility main body is inadequately invested; finally, the legal construction is lagging behind. The collective and the peasants take part of the funds, which are the requirements of the unity of power and responsibility. The source of collective funds should be taken into consideration: in the rural social security law, the funds for agricultural insurance can be extracted from the profits of the collective enterprises; and the property law is perfected. Relevant regulations draw agricultural insurance funds from the income of land and woodland, amend the labor law to provide employers with social security funds according to law. The source of farmers' personal funds can be taken into consideration: perfecting the rural land contract law, making full compensation for farmers in the land expropriation, formulating regulations and regulations to introduce more benefiting farmers' policies, and formulating the household registration law and reforming the household registration system.
