无锡市人事仲裁工作的实践与思考

【摘要】:正 一、无锡市人事争议仲裁管理初见成效 为加强无锡市人事争议仲裁工作的开展,无锡市人事局在《劳动法》、《江苏省人才流动管理暂行条例》的基础上,制订了《无锡市人才流动争议仲裁暂行办法》及其实施细则,建立了人才流动争议仲裁委员会和一支相应的仲裁队伍。人才流动中因辞职、辞退或违纪处理以及连带住房、培训费等财产问题、合同管理中的违约责任纠纷等比较多,两者约占案例总数的80%以上。这些纠纷绝大部分在单位内部就可以解决,但也有当事人自身无法处理的,只能通过上级仲裁机构调解或仲裁,甚至向法院起诉。对此,无锡市人才流动争议仲裁机构坚持做到:一搞好宣传教育,通过媒体宣传和接待来信来访开展政策咨询与教育工作,防患于未然;二注重调解,先后妥善解决了上千例人才流动纠纷,如:无锡市波纹管厂在一次公开招聘

In order to strengthen the development of Wuxi personnel dispute arbitration, the Wuxi personnel Bureau, on the basis of the Labor Law and the interim regulations of Jiangsu Province on the Management of the flow of talents, The interim measures for arbitration of talent flow dispute in Wuxi city and its implementing rules are formulated, and the arbitration committee of talent flow dispute and a corresponding arbitration team are established. There are many property problems such as resignation, dismissal or violation of discipline, associated housing, training fees, and disputes about breach of contract in contract management, which account for more than 80% of the total number of cases. Most of these disputes can be resolved within the unit, but there are also parties themselves can not handle, only through the higher arbitration institutions mediation or arbitration, or even to the court.
