家政工工伤保险问题研究

【摘要】：我国目前约有两千多万家政工,但其权益保护状况堪忧。他们不能体面劳动,易受伤害,再加上有关法律法规的不完善,使家政工劳动权益维护尤其是工伤权益救济始终是一个难题。本文从四个方面介绍了家政工工伤保险问题,旨在透视家政工背后的现象,呼吁关于保护家政工权益的专门性立法的出台,给予家政工以劳动法上劳动者的地位,将家政工纳入工伤保险的范畴,给予家政工以全面的工伤救济。第一章从概念层面了解家政工,介绍了家政工的类型、法律地位,家政服务业涉及的法律关系；第二章从家政工目前的工伤事故状况出发,探讨我国目前对家政工工伤保障的路径选择及障碍,得出将家政工纳入工伤保险范畴的必要性；第三章针对家政工纳入工伤保险范畴的社会难点问题和法律难点问题进行分析；第四章在总结理论和实践经验的基础上,提出将家政工纳入工伤保险范畴的法律对策。
[Abstract]:At present, China has more than 20 million domestic workers, but its rights and interests protection is worrying. They can not work decent, vulnerable, coupled with the relevant laws and regulations are not perfect, the domestic workers' rights and interests protection, especially industrial injury rights and benefits has always been a problem. This paper introduces the industrial injury insurance of domestic workers from four aspects, aiming at the phenomenon behind domestic workers, calling for the introduction of special legislation to protect the rights and interests of domestic workers, and giving domestic workers the status of laborers in labor law. Domestic workers will be included in the scope of industrial injury insurance, to give domestic workers with comprehensive industrial injury relief. The first chapter introduces domestic workers from the conceptual level, introduces the types, legal status of domestic workers, domestic service related to the legal relationship; the second chapter from the current situation of domestic workers at work accidents, This paper probes into the path choice and obstacles of the work-related injury insurance for domestic workers in our country at present, and concludes that it is necessary to bring domestic workers into the category of industrial injury insurance. The third chapter analyzes the social and legal difficulties of bringing domestic workers into the category of industrial injury insurance. On the basis of summing up the theoretical and practical experience, the fourth chapter puts forward the legal countermeasures to bring domestic workers into the category of industrial injury insurance.
