拖欠农民工工资有效约束机制研究

【摘要】:农民工是当代中国社会急剧变革时期出现的一种特殊社会现象,农民工的产生是一个社会历史变迁的过程,农民工的出现具有历史的合理性及其进步意义,对中国城市和乡村空间区域的经济和社会发展产生深远的影响。但是由于历史和现实等原因,致使广大农民工的权益得到不切实保障。长期以来,,老板拖欠农民工工资、农民工工伤事故频发且无人负责、工人生活环境极端恶劣等现象严重存在,农民工成为当代中国权益最受到损害的弱势群体。最为严重和普遍的就是拖欠农民工工资,这不仅对农民工生命生存本身构成了严重威胁,而且也对社会的稳定和谐造成了极为严重的危害。本研究以马克思主义理论以及科学发展观、构建和谐社会等相关理论为指导,从现状描述和案例分析入手,深入研究拖欠农民工工资产生的深刻社会原因及对社会的危害,在此基础上提出建立拖欠农民工工资的长效约束机制和相关对策建议。 一、本论文通过研究得出了如下结论 (1) 大量拖欠农民工工资现象的产生有其深刻复杂的原因,既有农民工本身因素质低下和缺乏组织而不能或无力维护自身权益原因,更有企业诚信缺失、政府监管不力等的原因,同样也存在市场机制不完善、法律约束有漏洞、社会诚信道德体系不健全等社会原因。 (2) 拖欠农民工工资严重危害到社会的稳定,是农民工滋生犯罪的一个重要诱因;同时也是对市场经济秩序和社会诚信道德建设的挑战;更会影响到我国“三农”问题的顺利解决,阻碍社会的和谐发展和进步。 (3) 建立拖欠农民工工资的长效约束机制,最重要的是构建约束拖欠农民工工资的完善的法律法规和制度体系。完善配套的法律法规体系是基础,严格完善的行政管理、行政执法以及农民工权益保障、建设项目工程工资保证金、预、垫付工资等制度体系是保证。 (4) 建立拖欠农民工工资的长效约束机制还需要综合治理,提高农民工的素质,增强农民工的维权意识和观念,建立农民工组织,改变农民工在就业过程中的弱势地位是前提;政府严格执法,以身作则,营造一个诚信和谐友好的社会风气和氛围,使企业内生诚信守法经营的管理文化理念是必要的条件。 二、本研究就建立拖欠农民工工资的长效约束机制提出了如下政策建议 (1) 加快户籍管理制度改革,建立公平的户籍管理制度。通过改革现行的城乡分治的户籍管理政策,取消把我国公民户口分为农业户口和非农业户口,从而为农村剩余劳动力向城镇转移,并促使“农民工”身份的根本转变消除制度障碍,为根本上解决农民工问题提供基本的制度保障。 (2) 制定保护农民工的法律法规。在目前政策条件下,应尽快制定专门保护进城务工农民的法制法规,即使不制定专门法律,也要对现行的《劳动法》进行修改完善,强化保护弱势群体如农民工的最基本权益。 (3) 结合社会主义新农村建设,在城乡区域享受均等化基本公共服务的原则下,加大对农民教育和培训的资金投入,特别是加大对进城务工人员的基本文化素质和技能的培训。并制定相关政策鼓励社会力量以及雇佣农民工企业对农民工进行文化和技能教育培训。
[Abstract]:Migrant workers are a special social phenomenon in the period of rapid transformation of Chinese society. The emergence of migrant workers is a process of social and historical changes. The emergence of migrant workers has historical rationality and progressive significance. It has a profound influence on the economic and social development of Chinese urban and rural space areas. But because of history, it has a profound influence on the economic and social development of China's urban and rural space areas. As a result, the rights and interests of the rural migrant workers are not guaranteed. For a long time, the boss is in arrears with the wages of migrant workers, the accidents of migrant workers are frequent and no one is responsible, and the living environment of the workers is extremely bad. The peasant workers have become the most vulnerable groups in the contemporary China. It is to arrears the wages of migrant workers, which not only poses a serious threat to the life and survival of the migrant workers, but also causes serious harm to the stability and harmony of the society. This study is guided by the theory of Marx doctrine and the construction of a harmonious society, such as the Scientific Outlook on Development, the construction of a harmonious society, and the in-depth study of the status description and case analysis. On the basis of the profound social reasons for the wage arrears of migrant workers and the harm to the society, this paper puts forward a long term restriction mechanism and relevant countermeasures for the wage arrears of migrant workers.
First, this paper draws the following conclusions through the study
(1) a large number of arrears of the wage phenomenon of migrant workers has its profound and complicated reasons, not only the reasons for the poor quality and lack of organization but also the lack of organization and inability to maintain their rights and interests, the lack of good faith in enterprises and poor government supervision, as well as the imperfect market mechanism, loopholes in legal constraints, and social integrity. Social reasons such as the unsound system of Germany and other social reasons.
(2) the arrears of the wages of migrant workers seriously endangers the stability of the society, which is an important cause for the migrant workers to breed crime; it is also a challenge to the market economic order and the construction of social integrity and morality, and will also affect the smooth solution of the "three rural" problems in China and impede the harmonious development and progress of the society.
(3) to set up a long term restriction mechanism for the wage arrears of migrant workers, the most important thing is to build a perfect law and system for the wage arrears of migrant workers, and to perfect the system of laws and regulations as the basis, strictly perfected administrative management, administrative law enforcement and the protection of the rights and interests of migrant workers, and the construction project wage deposit, pre payment and payment. The system of capital and other systems is the guarantee.
(4) the establishment of a long term constraint mechanism for the wage arrears of migrant workers needs comprehensive management to improve the quality of migrant workers, enhance the awareness and concept of the rights of migrant workers, establish migrant workers' organizations and change the weak position of migrant workers in the process of employment; the government should enforce the law strictly and create a harmonious and friendly social atmosphere. And atmosphere, so that the management culture idea of enterprise's integrity and law-abiding management is a necessary condition.
Two, this study puts forward the following policy recommendations on establishing a long-term constraint mechanism for arrears of wages for migrant workers.
(1) to accelerate the reform of the household registration management system and to establish a fair household registration management system. Through the reform of the current household registration policy of urban and rural division, it is necessary to remove the citizens of our country into agricultural and non-agricultural accounts, thus to transfer the surplus rural labor to the cities and towns, and to promote the fundamental transformation of "migrant workers" to eliminate institutional obstacles. To provide a basic system guarantee for solving the problem of migrant workers fundamentally.
(2) to formulate laws and regulations for the protection of migrant workers. Under the current policy conditions, the legal rules and regulations for protecting migrant workers in cities should be formulated as soon as possible. Even if no special laws are formulated, the current "labor law" should be revised and perfected, and the basic rights and interests of the vulnerable groups, such as migrant workers, should be strengthened.
(3) combined with the construction of new socialist countryside and the principle of equalization of basic public services in urban and rural areas, we should increase the investment in the education and training of farmers, especially the training of basic cultural qualities and skills for migrant workers, and formulate relevant policies to encourage social forces and employ migrant workers to migrant workers.
