【摘要】：船员工伤保险制度作为船员社会保障制度的一种,涉及宪法、劳动法、社会保险法、经济法、行政法等多个法律部门,且具有互济性、强制性的特点。但是,船员作为一种特殊的劳动群体,数量庞大,他们的工作条件、就业形式、工作风险等方面与普通的陆上劳动者存在着巨大的差异。然而,我国《船员条例》立法层级较低,且多用准用性规定,致使船员同普通陆上劳动者享受同样的工伤保险待遇,这就忽略了船员这一劳动群体的特殊性、流动性和高危性,对于保护船员权益极为不利。是以,对船员的工伤保险制度进行研究并对其中存在的法律问题进行分析,是必要且具有现实意义的。第一章,首先,归纳了船员工伤保险制度的相关概念;其次,立足于整个社会的角度分析工伤保险制度存在和建构的法理基础,包括社会连带主义和现代国家干预理论;然后,从保护船员生存权、船员职业特殊性和有效分散海上风险角度阐述船员工伤保险制度的特殊理论;最后分析我国船员工伤保险基本理论存在的问题。第二章,主要讨论《2006年海事劳工公约》中关于船员工伤保险的规定,分析我国履行海事劳工公约及其修正案过程中存在和可能存在的问题。第三章,主要分析我国船员工伤保险基金的募集和管理制度,并分析其中存在的问题。第四章,主要分析我国船员工伤保险赔偿制度,在这一部分,首先介绍几种有争议的工伤事故的认定,包括:船员于实习期间发生的人身伤亡损害事故的认定、船员于非工作时间发生的人身伤亡损害事故的认定和船员违法作业或受命违法作业期间发生的人身伤亡损害事故的认定;而后分析船员工伤保险赔偿请求权、商业保险赔偿请求权、民事侵权损害赔偿请求权之间的关系,最后提出我国船员工伤保险赔偿制度存在的问题第五章,依据前文所述,结合我国船员工伤保险制度中存在的主要问题,提出修改和完善我国船员工伤保险制度的合理化建议。
[Abstract]:As a kind of crew social security system, the crew injury insurance system involves many legal departments, such as constitution, labor law, social insurance law, economic law, administrative law and so on, and has the characteristics of mutual aid and compulsion. However, as a special labor group, the number of crew members is huge, their working conditions, forms of employment, work risks and other aspects have great differences with the ordinary land workers. However, the lower legislative level of the crew regulations in our country and the more applicable provisions result in the crew members enjoying the same treatment as the ordinary land-based workers, which ignores the particularity, mobility and high risk of the crew as a working group. It is extremely disadvantageous to protect the rights and interests of the crew. Therefore, it is necessary and meaningful to study the work injury insurance system of crew and analyze the existing legal problems. The first chapter, first, summarizes the related concepts of the crew injury insurance system; secondly, analyzes the legal basis of the existence and construction of the injury insurance system from the perspective of the whole society, including social connectionalism and modern state intervention theory; then, This paper expounds the special theory of crew injury insurance system from the point of view of protecting crew members' survival rights, crew occupation particularity and effectively dispersing marine risks, and finally analyzes the problems existing in the basic theory of crew injury insurance in China. The second chapter mainly discusses the provisions of the Maritime Labour Convention of 2006 on crew injury insurance, and analyzes the existing and possible problems in the process of carrying out the Maritime Labour Convention and its amendment in China. The third chapter mainly analyzes the collection and management system of crew injury insurance fund in China, and analyzes the existing problems. The fourth chapter mainly analyzes the compensation system of crew injury insurance in China. In this part, the author first introduces the identification of several kinds of controversial industrial accidents, including: the identification of personal injury and injury accidents that occurred during the crew practice, The identification of personal injury and injury accidents that occur during the non-working hours of the crew members and the identification of the personal injury and injury accidents that occur during the crew's illegal operations or during the period of the assigned illegal operations, and the analysis of the crew members' right to claim compensation for injury at work, The relationship between the claim right of Commercial Insurance compensation and the claim right of Civil Tort damage compensation. Finally, the problems existing in the compensation system of crew injury insurance in China are put forward in the fifth chapter, according to the above mentioned, According to the main problems existing in China's crew injury insurance system, this paper puts forward some reasonable suggestions for modifying and perfecting the system of China's crew injury insurance system.
