劳动关系法律调整模式论——从《劳动合同法》的视角解读

【摘要】:劳动关系的调整方式包括个体自治、团体自治和国家强制。由于劳动关系当事人双方缺乏民事主体平等性和互换性的基础,因此,劳动合同中的个体自治实际上是雇主单方主导的,对于劳动者而言其自治空间较小。因此,对劳动关系的调整不能简单地适用私法自治,而需采取多种调整方式,尤其是强调团体自治和国家强制,以协调劳动合同双方当事人的利益以及社会安全的利益。这一点在新颁布实施的《劳动合同法》上得到了充分体现。
[Abstract]:The adjustment of labor relations includes individual autonomy, group autonomy and state coercion. Due to the lack of equality and interchangeability between the parties to labor relations, the individual autonomy in labor contracts is actually dominated by employers and has less autonomy for workers. Therefore, the adjustment of labor relations can not simply apply private law autonomy, but need to adopt a variety of adjustment methods, especially the emphasis on group autonomy and state coercion, in order to coordinate the interests of both parties to labor contract and the interests of social security. This point has been fully embodied in the newly promulgated Labor contract Law.
