列宁劳动法思想及其当代价值研究

【摘要】:列宁创立了世界上第一个社会主义国家,同时他也颁布了人类历史上第一部社会主义劳动法典。他在继承和发展马克思恩格斯劳动法思想的基础上,从俄国社会主义革命和苏维埃政权建设的实际情况出发,阐述了一系列劳动法理论学说并建立了社会主义劳动法律制度。列宁劳动法思想不仅包涵着广大劳动群众共同反对资产阶级压迫和剥削以及废除资产阶级劳动法制的丰富经验和深刻理论,而且包涵着第一个无产阶级专政国家建设社会主义劳动法制的经验和理论成果。今天我们研究列宁劳动法思想,就是要发现列宁劳动法思想的理论精髓和普遍价值,要站在现代社会发展的高度,结合中国特色社会主义法制建设现状和要求,用新的思维思索列宁劳动法思想的真实面貌和精神实质,从中领悟出那些对至今发展仍具有重要价值和启迪意义的原则和方法。本文将以马克思主义的经典著作和文献资料为依据,以整理、归纳、总结列宁劳动法思想为主要内容,以结合当前实际进行客观评论为落脚点。全文共分为五个部分:第一个部分,列宁劳动法思想的理论来源。列宁汲取了马克思恩格斯关于揭露资产阶级本质的劳动法思想、历史唯物主义视域下的劳动法思想以及实现人的全面发展的劳动法思想的精华,在此基础上,丰富和发展了马克思恩格斯的劳动法思想。第二个部分,列宁劳动法思想的发展历程。列宁劳动法思想经历了一个长期的形成和发展过程。19世纪末,列宁运用马克思主义理论对俄国资产阶级劳动法的虚伪性进行了有力的批判和驳斥,开启了社会主义劳动法思想的理论探索之路。十月革命胜利后,列宁带领俄国劳动人民建立了苏维埃政权,国家的一切权利属于广大劳动者,社会主义劳动法制得以确立和发展。新经济政策期间,列宁认为随着苏俄新形势的发展,社会主义劳动法制建设也应该顺应新的变化得到修改和完善,此时,列宁劳动法思想得以进一步发展和完善。第三个部分,列宁劳动法思想的主要内容。列宁劳动法思想主要包括:以保护劳动者利益为价值追求,保证劳动条件基准的劳动法思想;以维护劳动者权利为宗旨,加大对劳动者保护力度的劳动法思想;以劳动者全面发展为归宿,加强劳动纪律和监督的劳动法思想;以广大劳动群众为本位,协调和处理劳动关系的劳动法思想。第四个部分,列宁劳动法思想的主要特征。列宁劳动法思想具有真实性、实践性、继承性和创新性。列宁劳动法思想所蕴含的重要特征值得我们深入思考和领悟,并从中探索出社会主义劳动法的内在规律性。第五个部分,列宁劳动法思想对我国构建和谐劳动关系的启示。研究列宁劳动法思想的最终目的就是考察列宁劳动法思想对中国实践的重要价值和现代启示。当前中国法律关系面临着劳动关系不稳定的问题。而列宁坚持以劳动者为本位,在立法、执法、司法、法律教育等方面加强对劳动者权益保护的思想对我国构建和谐劳动关系具有重要的启示意义。总之,我们研究列宁劳动法思想,并不是简单地回到列宁主义,更不是机械地搬运列宁劳动法思想的现成理论去解决当前的实践问题,而是要探讨和学习它的理论价值和现实意义,吸收和借鉴列宁劳动法思想的精华并结合当前中国实际情况,在实践中开拓出建设社会主义劳动法制和构建社会主义和谐劳动关系的新路径。
[Abstract]:Lenin founded the first socialist country in the world, and he also promulgated the first socialist labor code in human history. On the basis of inheriting and developing the thought of Marx Engels's labor law, he expounded a series of labor law theories, starting with the actual situation of the Russian Socialist Revolution and the construction of the Soviet political power. The socialist labor law system was set up and established. Lenin's labor law thought not only covered the rich experience and profound theory of the common opposition to bourgeois oppression and exploitation and the abolition of the bourgeois labor law, but also included the experience and reason of the first proletarian dictatorship to build a socialist labor legal system. On the basis of the results of Lenin's labor law, we should find out the essence and universal value of Lenin's labor law. We should stand in the height of the development of modern society, combine with the status and requirements of the construction of socialist legal system with Chinese characteristics, and take a new thinking to think about the true face and spirit of Lenin's labor law. According to the classical works and documents of Marx's doctrine, this article will be based on the classic works and documents of Marx's doctrine, and take up, sum up, sum up Lenin's labor law as the main content, and make objective comments on the current practice. The full text is divided into five parts: the first part The theoretical source of Lenin's labor law thought. During the new economic policy, Lenin thought that with the development of the new situation of Soviet Russia, the construction of socialist labor legal system should also conform to the new changes. At this time, the thought of Lenin's labor law was further developed and perfected. The third parts, the main content of Lenin's labor law thought. Lenin's labor law thought mainly included: the labor law thought with the protection of the interests of workers as the pursuit of the value of the labor and the standard of labor conditions. The labor law thought of protecting strength; taking the overall development of the laborers as the home, strengthening the labor law thought of labor discipline and supervision; the labor law thought which takes the masses of the masses as the standard and coordinating and dealing with the labor relations. The main features of Lenin's labor law thought are fourth parts. The Lenin labor law thought is true, practical, inheriting, and the thought of labor law. The important features of Lenin's labor law thought are worth thinking and understanding, and exploring the inner regularity of the socialist labor law. The fifth part, Lenin's labor law thought on the construction of harmonious labor relations in China. The ultimate aim of Lenin's labor law is to examine Lenin labor law. In view of the important value and Modern Enlightenment of China's practice, the current legal relations in China are facing the problem of instability in labor relations. While Lenin adheres to workers as the standard, strengthening the protection of workers' rights and interests in legislation, law enforcement, judicature and legal education has important implications for the construction of harmonious labor relations in China. We study Lenin's thought of labor law, not simply to return to Lenin's doctrine, and not to solve the current practical problems by mechanically moving Lenin's theory of labor law, but to explore and learn its theoretical and practical significance, absorb and draw on the essence of Lenin labor law and combine the actual situation of the current China. In practice, we have opened up a new path to build a socialist labor law and build a harmonious socialist labor relationship.
