完善我国集体合同制度中的法律责任

【摘要】：集体合同制度作为调整集体劳动关系的一项重要法律制度虽然已经在我国施行多年,但仍存在诸多问题,其中最突出的问题就是集体合同签订率很高但是履约率却很低。之所以出现这种现象,笔者认为这主要是因为我国集体合同制度中对违反集体合同制度的行为缺少相应的法律责任规定。本文从集体合同制度的基本概念出发,运用比较分析的方法对我国集体合同制度中法律责任做了一定程度的分析,并对完善我国集体合同制度法律责任提出了一些自己的看法。文章正文由四部分组成:第一部分主要对集体合同与集体合同制度进行了界定和区分,归纳了集体合同制度法律责任的特征。第二部分分析了集体合同制度中存在的法律关系、责任主体以及责任形式。第三部分主要介绍了我国目前有关集体合同制度法律责任的全国性以及地方性立法的情况以及存在的缺陷。第四部分针对我国集体合同制度法律责任立法中存在的问题提出了一些完善法律责任的思考。
[Abstract]:As an important legal system to adjust collective labor relations, the collective contract system has been implemented in China for many years, but there are still many problems, among which the most outstanding problem is that the signing rate of collective contract is very high but the performance rate is very low. The reason for this phenomenon is that it is mainly due to the lack of corresponding legal liability in the system of collective contract in our country. Starting from the basic concept of collective contract system, this paper makes a certain degree of analysis on the legal liability in our collective contract system by means of comparative analysis, and puts forward some views on perfecting the legal responsibility of collective contract system in our country. The text is composed of four parts: the first part defines and distinguishes the collective contract and collective contract system, and summarizes the characteristics of the legal responsibility of collective contract system. The second part analyzes the legal relationship, the subject of responsibility and the form of responsibility in the system of collective contract. The third part mainly introduces the national and local legislation on the legal liability of the collective contract system in China. The fourth part puts forward some thoughts on how to perfect the legal liability in the legislation of legal liability of collective contract system in our country.
