基于社会建构论的企业劳动关系演变研究

【摘要】: 企业劳动关系是劳动过程中雇主与雇员之间的一切合作和冲突关系。它受一定社会经济、技术、政策、法律制度和社会文化背景的影响,是企业人力资源管理的一个特定领域。目前,中国经济增长方式正处于由粗放型向集约型转变的历史变革时期,企业劳动关系的和谐发展是整个社会稳定的必要条件。改革开放30年以来,企业劳动关系发生深刻变化的同时正面临着前所未有的冲击和考验。 本文从社会建构论视角出发,对1994年《劳动法》颁布以来企业劳动关系的演变展开探究。依据社会话语的建构宣称,将企业劳动关系从媒介话语、学术话语、政策话语三个方面进行细分归类、探索分析。一方面对相关文献进行综述,在吸收、综合国内外研究成果的基础上,确定基于企业劳动关系这个社会问题建构的分析框架;另一方面对相关社会影响因素进行界定,并且对社会话语及行为的发展规律进行探讨,以找寻企业劳动关系的演变历程。重点通过运用文献研究法,考察一定时期内企业劳动关系被传媒、学术及政策话语所建构的现实问题及其演变,具体利用“数据搜集→分类观察→定量描述→定性总结”的研究范式来探讨企业劳动关系问题的演变轨迹及周期特征。 本文研究发现:首先,自1990年代中期以来,改制和市场化是国有体制内企业劳动关系演变的两个主要方面;而在非国有领域,规范和法制化是企业劳动关系演变的主旋律。其次,企业劳动关系发展越来越走向法制化,走向保护劳动尊严。媒介话语、学术话语和政策话语三大宣称主体相互作用,共同促进企业劳动关系的稳定有效运作,尤其“和谐”社会目标推出之后,弱势劳工地位被三大话语所关注并促使其变化。从三大话语对劳动关系的未来建构来看,一方面,劳动关系越来越契约化,而且契约越来越规范;另一方面,劳动者权益保护体制会日益完善,是我国企业劳动关系将来的发展方向。
[Abstract]:Enterprise labor relationship is all the cooperation and conflict between employer and employee in the process of labor. Influenced by social economy, technology, policy, legal system and social and cultural background, it is a special field of enterprise human resource management. At present, China's economic growth mode is in the period of historical transformation from extensive to intensive. The harmonious development of enterprise labor relations is a necessary condition for social stability. Since the reform and opening up 30 years ago, the labor relations of enterprises have undergone profound changes and are facing unprecedented impact and test. From the perspective of social constructivism, this paper probes into the evolution of enterprise labor relations since the promulgation of Labor Law in 1994. According to the construction of social discourse, the labor relations of enterprises are classified and analyzed from three aspects: media discourse, academic discourse and policy discourse. On the one hand, on the basis of absorbing and synthesizing the research results at home and abroad, this paper summarizes the relevant literature, and determines the analytical framework based on the construction of the social problem of enterprise labor relations; On the other hand, it defines the relevant social influence factors, and probes into the development law of social discourse and behavior in order to find out the evolution course of enterprise labor relations. By using the method of literature research, the paper examines the realistic problems and their evolution of enterprise labor relations constructed by the media, academic and policy discourse in a certain period of time. This paper discusses the evolution track and periodic characteristics of labor relations in enterprises by using the research paradigm of "quantitative description and qualitative summary of data collection classification and classification". This paper finds that: first, since the mid-1990s, restructuring and marketization are the two main aspects of the evolution of labor relations in state-owned enterprises, while in non-state-owned areas, standardization and legalization are the main melody of the evolution of enterprise labor relations. Secondly, the development of enterprise labor relations is moving towards legalization and protection of labor dignity. Media discourse, academic discourse and policy discourse claim that the main body interacts together to promote the stable and effective operation of enterprise labor relations, especially after the launch of the "harmonious" social goal. The weak position of labor is concerned by the three major words and impels it to change. On the one hand, the labor relationship is more and more contracted, and the contract is more and more standardized; On the other hand, the system of labor rights protection will be perfected day by day, which is the future development direction of labor relations in our country.
