农村劳动关系探讨

【摘要】: 我国是一个农业大国,农村人口占全国人口的60%左右。在我国,农民不仅是农业的主体,更是国家的主体,中国经济的发展、和谐、稳定离不开关注农民、关注农业、发展农村。然而农民作为我国最主要的劳动者,其所拥有和享受的权利存在着严重的缺失性,如农村劳动者没有发展权和享受权等。更为严重的是,新《劳动法》的颁布,使得城镇职工的劳动者权益受到更加全面的保护,而同时,占我国人口60%之多的农村劳动者的权益却仍未被纳入到《劳动法》的调整范围内,可以说农村居民仍然处于我国社会保障体系的最边缘,甚至被排挤在外。 本研究的重点是从中国农村现状及农村劳动关系现状出发,通过对农村劳动关系概念、特点及存在问题的研究,借鉴国内企业职工劳动关系与国外农村劳动关系的成功经验,同时汲取失败教训,运用定性分析与定量分析相结合的方法,基于人力资本原理、劳动经济学原理,结合我国国情,首次提出并尝试明确农村劳动关系的概念,并从其特点和现状出发,提出建立科学规范农村劳动关系的措施建议,旨在为农村劳动者提供有别于土地的另一可靠保障,提高农村劳动者这一弱势群体的地位,为促进农业和农村经济持续稳定的发展,建设社会主义和谐新农村提供借鉴。 本研究的主要研究内容和框架:第一章从研究背景出发,分析了农村劳动关系研究的目的和意义,概括目前国内外研究动态,并给出研究的思路和方法;第二章结合中国农村发展现状,界定了农村劳动关系基本内涵,并对中国农村劳动关系的发展历程进行了简单回顾及对其类型进行了划分,最后总结了中国农村劳动关系的特点;第三章主要结合统计数据分析了中国农村劳动关系现状;第四章在第三章基础上对现阶段中国农村劳动关系存在的问题及其原因进行了全面分析;第五章针对第四章存在问题,提出建立和谐规范农村劳动关系的思路;第六章在总结前述五章基础上重点分析了中国农村劳动关系发展方向及对策建议,第七章对本研究的内容进行了简要的总结。 本研究的主要创新见解:(1)首次尝试并提出农村劳动关系的概念和特点。(2)基于对农村劳动关系影响因素的具体分析,提出通过优化农村基本组织制度、健全相应的法律法规、规范农村劳动关系管理机构及其中介行为的思路完善优化农村劳动关系。(3)从我国的基本国情出发,提出适合我国农村劳动关系发展的对策建议:首先,从集体或政府角度出发,借鉴国外政府与农民的关系,结合我国自身特点,采取合同方式,运用价格和收入相结合的方法对农民进行补贴与支持,加强信贷等优惠政策,建立科学合理的保障体系;其次,从农地角度出发,借鉴国外农场经验,结合我国自身的特点,适当进行农地规模经营,向国外农场、农业工人方向发展,发展农业信贷运用价格和收入相结合的方法对农民进行补贴与支持,加强信贷等优惠政策,建立科学合理的保障体系;再次,从农民角度出发,要通过提升劳动力素质,加大对农村文化教育的政策支持和资金投资力度,提升农村人力资本存量和质量,稳定农村劳动关系;最后,从农村劳动关系入手完善双层经营体制功能,以家庭承包责任制为基点展开的农村劳动关系的规范与完善。
[Abstract]:China is an agricultural power, and the rural population accounts for about 60% of the country's population. In our country, the farmers are not only the main body of agriculture, but also the main body of the country. The development, harmony and stability of China's economy are inseparable from the attention of the farmers, the agriculture and the development of the rural areas. However, as the most important worker in our country, the rights of the peasants, such as rural workers, lack the right to development and the right to enjoy. It is more serious that the enactment of the new Labour Code makes the workers' rights and interests of the urban workers more comprehensive, and at the same time, the rights and interests of the rural workers accounting for more than 60% of the country's population are still not included in the adjustment range of the Labor Law. It can be said that rural residents are still the most marginalized and even excluded from the social security system of our country. The focus of this study is to study the concept, characteristics and existing problems of rural labor relations from the present situation of rural labor relations in China and the current situation of rural labor relations. The method of combining qualitative analysis with quantitative analysis, based on the principle of human capital and the principle of labor economics, combined with the national conditions of our country, put forward and tried to define the concept of rural labor relations for the first time and from its characteristics and present situation. The paper puts forward the measures to establish a scientific and standardized rural labor relation, which is aimed at providing the rural workers with another reliable guarantee, which is different from the land, and to improve the status of the disadvantaged groups in the rural workers. Chapter four, on the basis of the third chapter, analyses the existing problems and the causes of the rural labor relations in China, and puts forward the establishment of a harmonious and standardized rural area for the existing problems in the fourth chapter. Chapter 6, on the basis of summarizing the five chapters, analyzes the development direction and the countermeasures of the rural labor relation in China, and the contents of Chapter 7 on this study A brief summary is made.
