“女性禁忌从事的劳动”再思考

【摘要】：《女职工劳动保护规定》自1988年颁布以来,在妇女权益保护和女职工劳动保护方面发挥了重要作用。但是,在中国社会转型期和全球化的背景下,原有《规定》中确立的原则和适用性受到挑战,这就为进一步修订提出了要求。为了反映这一要求,《女职工劳动保护条例》(修订草案)经过反复讨论,在其适用范围、女职工劳动保护标准、生育保险待遇、女职工劳动合同、法律责任等方面做出了重要修改,在进一步保障女职工平等的就业权利、生育保障权利、健康权利和法律权利等方面提出了建设性意见。在《条例》修订草案讨论和征求意见之际,进一步对《条例》修改的原则、修改的依据、适用范围、保护程度、生育保护、以及其他应增加的内容等进行讨论,具有非常重要的意义。《妇女研究论丛》为了体现立法者、不同领域专家和实际工作者对本《条例》修改的观点和看法,特别设立本专栏,邀请各方面领导和专家参与讨论,贡献智慧,推动立法进程。
[Abstract]:Since its promulgation in 1988, the provisions on the Protection of Women's Rights and interests have played an important role in the protection of women's rights and interests. However, under the background of social transformation and globalization in China, the principles and applicability established in the original "regulations" are challenged, which puts forward the requirements for further revision. In order to reflect this requirement, the regulations on the Labor Protection of female Workers (revised draft) have been discussed repeatedly, in the scope of their application, the standards of labour protection for female workers, the treatment of maternity insurance, the labor contract for female workers, Some important amendments have been made in legal liability, and constructive suggestions have been put forward to further guarantee the equal employment rights of female workers, the right to reproductive protection, the right to health and the legal right. While discussing and soliciting comments on the draft amendment to the regulations, further discussions will be held on the principles, basis, scope of application, degree of protection, maternity protection, and other contents that should be added to the revised regulations, It is of great significance. [on Women's Studies] to reflect the views and views of legislators, experts in different fields and practitioners on the amendments to the regulations, this column has been set up specifically to invite leaders and experts from all walks of life to participate in the discussions, To contribute wisdom and promote the legislative process.
