中国女性平等工作权研究
[Abstract]:One of the symbols of a country's social civilization is the realization of women's rights, and women's right to work is a very important right among their many rights. Because labor is not only a means of making a living, but also directly related to the development of individual creativity, the acquisition of personal dignity and so on. In our country, women's right to work is protected by laws, regulations and policies. The first socialist Constitution of our country clearly stipulates the legal provisions of labor rights. The Labor Law and the Law on the Protection of Women's Rights and interests have different provisions. However, with the development of market economy and the reform of political system, the provisions of individual legal provisions can no longer fully reflect and satisfy the equality between women's right to work and men's right to work, and many violations of women's right to work are becoming more and more serious. Therefore, it is necessary to solve the problem of realizing women's equal right to work in our country. First of all, the article gives an overview of women's equal right to work. Combined with the views of experts at home and abroad, this paper analyzes and clarifies the meaning and characteristics of the right to work, with emphasis on the legal status of the subject of the right, and analyzes the relationship between the right to work and the right to work, the right to employment and the right to survival. After that, the article expounds the content of equal right to work, and focuses on the significance of protecting women's equal right to work. Secondly, this paper focuses on the typical countries of the United States, Britain and Switzerland, investigates the current situation of the legal protection of their women's right to work, and sums up some of the contents that should be used for reference by our country and the parts that should be warned of. Thirdly, this paper explores the current situation of the protection of women's equal right to work in China. The legal provisions are interpreted comprehensively and the shortcomings are summarized. While recognizing the achievements made in the protection of women's equal right to work since the founding of the people's Republic of China, we should also see the real inequality between men and women and the inequality between women, and analyze the causes of these inequalities. At the end of the article, combined with the foreign experience mentioned above, this paper puts forward some opinions and suggestions on law, policy, concept, implementation and so on.
