经济学视野下的专利保护强度之大国比较研究

【摘要】：专利保护的实际效果不仅取决于相关法律法规体系的完善程度,还与执法强度密切相关。研究发现随着中国不断加强知识产权的保护,中国的专利相关法规也逐渐与国际接轨。同时,本文在既有GP指数基础上引入专利执法强度的概念,以每5万人所占律师比例、人均GDP、专利有效数/专利申请数和专利侵权结案率作为测定专利保护强度中执法力度的指标,经过本文的专利保护强度的测定得出中国专利的执法强度约为0.57左右,在专利法规已与国外专利大国差距不大时,更需要提升的是执法强度,藉以构建良好的专利市场环境,才能显著提升中国专利保护的效果。此外,本文还发现中国在专利相关法规修法之后短期会呈现较高的专利保护强度。
[Abstract]:The actual effect of patent protection not only depends on the degree of perfection of the relevant laws and regulations system, but also closely related to the intensity of law enforcement. The study found that with the continuous strengthening of the protection of intellectual property rights in China, China's patent related laws and regulations are gradually in line with the international standards. At the same time, based on the concept of both the GP index on the basis of the introduction of the patent law enforcement strength, 50 thousand people per share ratio, per capita GDP, a patent lawyer number / the number of patent applications and patent infringement determination as the closing rate of patent protection in the law enforcement strength index, the patent protection strength determined that law enforcement strength China patent is about 0.57, and foreign patent in the patent law has big gaps, but also need to enhance the strength of law enforcement, so as to build a good market environment can significantly improve the patent, patent protection Chinese effect. In addition, this paper also finds that China will present a higher patent protection intensity in the short term after the patent related laws and regulations.
