电视节目模板的法律保护问题研究

【摘要】：近年来，电视节目模板产业在全球范围内迅速发展，成为多个国家电视产业经济发展的重要组成部分。由于我国电视产业起步较晚，节目形态较为单一，从电视节目模板兴起之初，国内多家电视台就以“克隆”的方式制作电视综艺节目，这种“借鉴”无需对原作者支付任何费用，，却在节目内容和形式上进行大量的复制抄袭，严重损害了原制作方和播出人的创作积极性和经济利益。从世界范围看，目前尚未有国家对电视节目模板进行明确保护，但英美法系和大陆法系国家以及部分国际组织都已在司法实践和立法探索方面做出了一定的努力，对电视节目模板进行法律保护成为现今全球电视产业界和法律界人士关注的重要内容。我国在电视节目模板立法上的缺失和司法实践上的空白使得我国对电视节目模板的保护停滞不前，但近年来国内因电视节目模板“克隆”引起的法律纠纷频繁出现，成为困扰电视产业界和法律界的一大难题。随着电视节目模板产业的迅速发展，迫切需要对电视节目模板的概念、法律属性和立法研究进行理论和实践上的探索和研究。本文第一章首先介绍了电视节目模板的研究背景及意义，对国内外研究现状进行综述，并提出本文的研究目的和创新之处；第二章对电视节目模板的内涵界定、内容构成及法律属性进行探讨，明确电视节目模板是具有独创性的智力成果，具有可复制性，应当属于著作权法保护的作品范畴，构成本文的理论基础和分析依据；在第三章中本文对国外电视节目模板保护现状和保护难点进行了详细探讨，并总结分析国外电视节目模板法律保护对我国的启示；第四章对我国电视节目模板的法律保护现状及问题进行了研究，指出我国现有法律保护制度无法对电视节目模板进行有效保护；本文最后一章提出建立电视节目模板的著作权基础保护制度，完善相关配套法律保护体系，同时发挥国际法保护作用，对电视节目模板进行全方位的法律保护。
[Abstract]:In recent years, the television program template industry developing rapidly in the world, become an important part of the national television industry economic development. Because of China's TV industry started late, the program form is relatively single, from the rise of the television program template at the beginning, many domestic TV stations to "clone" of the making of TV variety show this "reference", without paying any fees to the original author, but copied a lot in the program content and form, serious damage to the original production and broadcast the creation of enthusiasm and economic benefits from the world, yet there are countries on the television program template of protection, but the British law and civil law countries and some international organizations have in judicial practice and legislative exploration made some efforts, on the television program template protection become the present world The important content of the television industry and the legal community.
China on the television program template the lack of legislation and judicial practice because of the protection of China's television program template is stagnant, but legal disputes in recent years due to domestic television program template "clone" caused by the frequent, become a big problem for the TV industry and the legal profession. With the rapid development of the television program template the urgent need for industry, the concept of television programs templates, to explore and study the theory and practice of the legal nature and legislation.
The first chapter introduces the research background and significance of the television program template, reviews the research status at home and abroad, and puts forward the research purpose and innovation; the second chapter defines the connotation of the television program template, discusses the content and legal attributes, clear the television program template is a highly creative intellectual achievements can be replicated, should belong to works protected by copyright law, constitute the basis in theory and analysis in this paper; the third chapter gives a detailed discussion on foreign television template conservation status and difficulties, and summed up the analysis of foreign television template legal protection inspiration to China; the fourth chapter legal protection status and on the issue of Chinese television program template was studied, pointed out that China's existing legal protection system can effectively protect the television program template; The last chapter puts forward the copyright protection system of TV program template, consummates the related legal protection system, and exerts the international law protection function, carries on the omni-directional legal protection to the TV program template.
