【摘要】: 随着现代科学技术的发展、市场经济的深化以及大众传媒的发达,自然人的人格权开始具有更多、更直接的财产利益,越来越多的被商业利用,人格权商品化已经成为一种发展趋势。但是我国传统民法对人格权商品化的保护有所欠缺,或是缺少对人格权商品化的保护,可无论是从推动理论创新、促进法学繁荣的角度出发,还是从应对经济生活中的实际问题、完善市场经济立法的角度来看,认真思考和研究人格权商品化问题、填补我国法律空白,具有重要的理论价值与实践指导意义。因此本文致力于研究人格权商品化的法律保护。本文首先介绍人格权的历史沿革与发展趋势,其次介绍人格权商品化的产生,再次分析人格权商品化法律保护的正当性,然后介绍我国人格权商品化法律保护的现状、不足,然后再借鉴国外人格权商品化保护的模式,最后致力于完善我国人格权商品化的法律保护。主要借鉴德国模式,完善我国人格权法,扩充人格权内容,承认人格权的可转让性、可继承性,最后确立人格权商品化法律救济方式以及规定对人格权商品化的法律限制。
[Abstract]:With the development of modern science and technology, the deepening of market economy and the development of mass media, the personality rights of natural persons begin to have more and more direct property interests, and more and more commercial use. The commercialization of personality rights has become a trend of development. However, the traditional civil law of our country has some deficiencies in the protection of the commercialization of personality rights, or the lack of protection of the commercialization of personality rights, whether from the promotion of theoretical innovation. From the perspective of promoting the prosperity of law, we should consider and study the commercialization of personality right from the point of view of dealing with the practical problems in economic life and perfecting the legislation of market economy, so as to fill in the gaps in our country's laws. It has important theoretical value and practical guiding significance. Therefore, this paper is devoted to the study of the legal protection of the commercialization of personality rights. Firstly, this paper introduces the historical evolution and development trend of personality rights. Secondly, it introduces the emergence of the commercialization of personality rights, analyzes the legitimacy of the legal protection of the commercialization of personality rights, and then introduces the status quo of the legal protection of the commercialization of personality rights in China. Then draw lessons from the foreign model of commoditization protection of personality rights, and finally focus on improving the legal protection of the commercialization of personality rights in China, mainly draw lessons from the German model, improve the law of personality rights of our country, expand the content of personality rights. The author recognizes the transferability and inheritability of personality right, and finally establishes the way of legal remedy for the commercialization of personality right and the legal restriction on the commercialization of personality right.
