【摘要】：中共中央、国务院《关于完善产权保护制度依法保护产权的意见》专门就加大知识产权保护力度提出了方法、路径和要求。国务院办公厅印发知识产权综合管理改革试点总体方案,探索建立高效的知识产权综合管理体制。党的十八届四中全会提出了行政检察的改革命题,即"检察机关在履行职责中发现行政机关违法行使职权或者不行使职权的行为,应该督促其纠正"。在深化改革和鼓励创新的时代背景下,回顾和考量知识产权行政检察的历史和实践,研究和探索知识产权行政检察的基本理念和重要途径,有助于推动形成知识产权保护的大格局。
[Abstract]:The opinions of the CPC Central Committee and the State Council on perfecting the system of property right Protection in accordance with the Law specifically put forward methods for strengthening the protection of intellectual property rights. Path and requirements. The General Office of the State Council has issued a pilot overall plan for the comprehensive management reform of intellectual property rights. The fourth Plenary session of the 18 CPC Central Committee put forward the proposition of administrative procuratorial reform. That is, "procuratorial organs in the performance of their duties found that the administrative organs illegally exercise their functions and powers, or do not exercise their functions and powers, should be urged to correct"... in the context of deepening reform and encouraging innovation in the background of the times. Reviewing and considering the history and practice of intellectual property administrative procuratorial, studying and exploring the basic idea and important ways of intellectual property administrative procuratorial work will help to promote the formation of a large pattern of intellectual property protection.
