我国同人作品的著作权问题研究

【摘要】:随着网络的普及,本来属于小众文化的同人作品的受众越来越多,同时,伴随着同人作品的流行与兴盛也产生了不少问题,尤其是同人作品的著作权问题。本文的第二部分将对我国同人作品的生存现状进行一个较为细致的描述,指出我国同人市场繁荣背后存在的种种问题,同时指出因为在我国现行的法律条文中缺乏对同人作品的明确定义和具体规范,使得同人作品的创作一直游走于合法与违法的边缘,而当其本身遭到侵权时也无法通过法律途径保护自身权益。 我国同人作品的著作权问题主要有两个内容:同人作品与被它使用的原作品之间的著作权纠纷问题;以及同人作者是否拥有其同人作品著作权的问题。针对这两个问题,在本文第三部分的论述中创新性地引入关于著作权与表达权之争的平等主义思想,将同人作品认定为创作者自由行使自己表达权的原创产物,其作者当然的拥有它的著作权,同时也因此同人作品与原作品在法律地位上是平等的,并非只有取得原作品著作权人许可才能进行创作,从法理基础上解决了前述的两个问题;并且在第三部分的论述中也会从我国促进文化发展这个大背景出发,指出同人作品大发展的背后是新时代的大众参与文化的崛起,在这个新形势下针对前两个问题做出当前的最优选择。 当我们从历史的角度看待这个问题时,我们会发现著作权法律所有针对著作权的规制都是为了平衡这种独占权利的益处和它可能对社会带来的负面影响,所以当现在这种平衡被打破,创造性被压制,同人作品存在的违法嫌疑就很可能是法律的问题而非它自身的问题。在这种情形下改变法律应当是最优选择,至少在旧法变新法的过渡期问中应当平衡对著作权的保护与鼓励更多地创新,从而保障公众的最大利益。因此本文的第四部分将会尝试在我国现行法律的框架之内通过借鉴国外的相关规定来解决我国同人作品的著作权问题。 从鼓励创作的立场出发,将同人作品纳入我国的法律框架之内,从而促进新时代的社会文化的发展和进步,这也是本文的研究意义所在。
[Abstract]:With the popularity of the network, the audience of the works belonging to the minority culture has become more and more. At the same time, with the popularity and prosperity of the works, there are also many problems. The second part of this paper will give a detailed description of the existing situation of Chinese co-human works, pointing out the problems behind the prosperity of the coowner market. At the same time, it is pointed out that because of the lack of clear definition and specific norms of the same person's works in the current legal provisions of our country, the creation of the same person's works has always been on the edge of legality and illegality. And when it itself is infringed, it can not protect its own rights and interests through legal channels. There are two main contents in the copyright of the co-owner 's works in China: the copyright dispute between the co-owner 's works and the original works used by it; And whether the co-author owns the copyright of his co-owner 's works. In view of these two problems, the third part of this paper discusses the innovative introduction of equal rights about copyright and the right of expression. The author of the same person works is regarded as the original product of the author's free exercise of his right of expression, and the author of the same person works has its copyright, and therefore the same person works and the original works are equal in the legal status. It is not only to obtain the license of the copyright owner of the original work to create works, but also to solve the two problems mentioned above on the basis of legal theory. And in the third part of the discussion will also from the background of promoting cultural development in China, pointing out that behind the great development of people's works is the rise of the new era of popular participation culture. In this new situation, the first two problems to make the current optimal choice. When we look at this issue from the historical point of view, we will find that all the copyright laws are aimed at balancing the benefits of this exclusive right and the negative impact it may bring to society. So when the balance is broken and creativity is suppressed, the suspicion of lawlessness in co-productions is likely to be a matter of law rather than its own. In this case, changing the law should be the best choice. At least in the transition period between the old law and the new law, the protection of copyright should be balanced and more innovation should be encouraged. Therefore, the 4th part of this paper will try to solve the copyright problem of co-owner 's works in our country by using the relevant regulations of foreign countries for reference within the framework of the current law of our country. In order to promote the development and progress of social culture in the new era, it is the significance of this study to bring the works of the same person into the legal framework of our country from the standpoint of encouraging creation.
