住宅小区结建人防工程平时使用问题研究

【摘要】：随着经济社会的快速发展,住宅小区结建人防工程如雨后春笋般快速建设发展,“平战结合”的方针得到了充分地贯彻落实。现在开发建设的住宅小区结建人防工程基本上用作汽车停放,缓解了小区当前停车困难的突出矛盾。然而由于目前的法律没有对住宅小区结建人防工程所有权归属予以明确界定,导致其平时使用过程中问题不断。笔者首先采用问题导向,通过分析住宅小区结建人防工程的立法现状和平时使用存在的问题,找出问题产生的原因是住宅小区结建人防工程所有权归属不明、平时使用权界定不清、平时使用管理混乱等。然后,通过对人防工程所有权归属的归国家所有、归开发商所有、归业主共有三个主要观点分析比较,从合法性和合理性上得出应归业主共有的结论。接下来,进一步对住宅小区结建人防工程平时使用权来源、平时使用权性质和内容、平时使用权的限制等方面展开分析。最后,通过前面的分析探讨,就现行法律框架下完善住宅小区结建人防工程平时使用管理,提出健全人防行政管理体系、加强对实际管理人业务指导、支持开发商让渡权利与业主等建议,并就住宅小区结建人防工程明确所有权归属、明确所有权权能、完善权属登记制度和完善维修资金保障制度等方面,提出立法建议。
[Abstract]:With the rapid development of economy and society, the civil air defense project of residential district is springing up quickly. The policy of "combination of peacetime and war" has been fully implemented. It alleviates the prominent contradiction of parking difficulty in residential area. However, the ownership of civil air defense project in residential district is not clearly defined because of the current law. As a result of its usual use of the process of continuous problems. Firstly, the author adopted problem-oriented, through the analysis of the residential district construction of civil air defense project legislation status and problems in peacetime use. To find out the reason for the problem is that the ownership of civil air defense project in residential district is not clear, the definition of the right to use is not clear, and the management of the civil air defense project is confused. Then, the ownership of civil air defense project is owned by the state. Owned by the developers, owners have three main points of view analysis and comparison, from the legitimacy and reasonableness of the conclusion that should belong to the owners. Next, further to the residential area construction of civil air defense works in peacetime sources. The nature and content of the usufruct at ordinary times, the limitation of the usufruct in peacetime are analyzed. Finally, through the analysis and discussion above, the author consummates the civil air defense project of residential district under the current legal framework. Put forward a sound civil air defense administration system, strengthen the actual manager business guidance, support developers transfer rights and owners and other suggestions, and residential residential building civil air defense project clear ownership, clear ownership power. To improve the property registration system and improve the maintenance fund security system, put forward legislative proposals.
