试论开放获取环境下图书馆复制的合理性

【摘要】：非开放获取环境下,图书馆复制服务往往陷入两难境地:图书馆向企业用户提供复制件被出版商认定是营利性使用而被禁止。开放获取使图书馆摆脱了这一法律困境,让复制变得合理合法、有据可依。开放获取与著作权法两者并行不悖,选择开放获取并不妨碍作者依法享有著作权法赋予的权利。开放获取环境下,资助机构、科研院所、出版商都实施开放获取政策,让图书馆复制的合理性得以彰显。但图书馆在提供开放获取服务时,也需注意防止可能出现的一些问题。
[Abstract]:In an open access environment. Library reproduction services are often caught in a dilemma: the provision of copies by libraries to corporate users is banned by publishers for profit. Open access has freed libraries from this legal dilemma. Open access is not inconsistent with copyright law. The choice of open access does not prevent the author from enjoying the rights conferred by copyright law. In the open access environment, funding institutions. Scientific research institutes and publishers all implement open access policies to make the rationality of library reproduction clear. However, libraries should also pay attention to prevent some possible problems when providing open access services.
