【摘要】：网络服务商是网络信息传输的中心,是网络空间传播和利用享有著作权作品的重要平台。在网络技术日益革新的环境下,著作权领域中尤其是复制权和信息网络传播权的保护面临着重重问题。因此,在现有的“互联网+”时代背景中,针对网络著作权保护薄弱的问题,我们有必要对现有著作权法律制度进行调整,既要保护著作权人的应有权利不受侵犯,也要维护网络服务商的产业利益不受阻碍,以此达到科技与权益在新时代背景下的平衡发展。本文运用案例分析和比较分析的方法,对网络服务商著作权侵权问题进行了详细地探讨。从实务角度出发,从相关网络服务商著作权侵权案例为着手,重点分析了网络服务商的侵权责任要件构成;从理论层面出发,在与我国法律体系与美国避风港原则对比的基础上,提出了关于如何完善对我国著作权侵权责任认定问题的建议。第一部分,简要陈述网络服务商著作权侵权问题,包括网络服务商的概念和作用等,对网络服务商著作权侵权问题的成因及现状进行分析,奠定对本论从理论与实务方面进一步深入探讨与研究的背景基础。第二部分,针对网络服务商著作权侵权行为以及该种行为如何认定展开研讨,通过分析网络服务商著作权侵权行为的表现形式并结合案例评析对相关问题进行研究,进而对于网络服务商著作权侵权行为的界定标准给出相应的观点。第三部分,通过对我国现行法律法规关于网络著作权侵权责任的一般形式规定进行比较分析,研究提出在新技术条件下,网络服务商在著作权侵权承担的形式,以及其责任认定,包括赔偿标准以及免责情形等方面的特殊性。第四部分,通过上述三部分的理论与实务的阐述,针对目前司法实践中存在的归责不明等问题提出具有操作性的立法建议和司法建议。
[Abstract]:Network service provider is the center of network information transmission and an important platform for the dissemination and utilization of copyright works in cyberspace. In the field of copyright, especially the protection of the right to copy and the right to spread information on the network is facing many problems. Therefore, in the background of the present "Internet" era, the protection of network copyright is weak. It is necessary for us to adjust the existing legal system of copyright, not only to protect the rights of copyright owners from infringement, but also to protect the industrial interests of network service providers without hindrance. In order to achieve a balanced development of science and technology and rights and interests in the new era. This paper uses the method of case analysis and comparative analysis to discuss the copyright infringement of network service providers in detail. From the perspective of practice. Starting from the case of copyright infringement of network service provider, the paper analyzes the constitution of tort liability of network service provider. From the theoretical level, on the basis of the comparison with the legal system of our country and the principle of safe haven in the United States, the author puts forward some suggestions on how to perfect the cognizance of copyright tort liability in our country. This paper briefly describes the copyright infringement of network service providers, including the concept and role of network service providers, and analyzes the causes and current situation of copyright infringement problems of network service providers. The second part is about copyright infringement of network service providers and how to identify this kind of behavior. Through the analysis of network service providers copyright infringement forms and combined with the case study of related issues. The third part, through the current laws and regulations of our country on the network copyright infringement liability of the general form of provisions for comparative analysis. Under the new technology condition, the paper puts forward the form of network service provider's copyright infringement, and the particularity of its liability, including the standard of compensation and the circumstances of exemption. Part 4th. Through the theoretical and practical exposition of the above three parts, the author puts forward some operable legislative and judicial suggestions in view of the problems of unclear imputation in the current judicial practice.
