论我国堕胎权的法律保障与限制

【摘要】：近年来,随着各种“人流”广告的不断泛滥,“堕胎”已不再是那个曾经令国人闻之羞涩、难以启齿的词语。人们观念上的转变、医疗技术上的进步、甚至经济条件上的宽裕,都让自愿“堕胎”成为分分钟的“小事”。而与此同时,却又有如“强制堕胎”这样的暴力行为屡见不鲜,让被动“堕胎”危及人权。正是这样一个既面临着泛滥,又隐藏着危害的“小事”,却关系到妇女权利、家庭的幸福、社会的稳定甚至民族的未来。而面对缺乏法律制约的堕胎行为,如何限制的同时更好地保障,就成为了摆在当下的重要课题。本文将从堕胎权的概念和特征着手,结合我国的实际现况,分析我国堕胎权保护的立法现状、执法现状、司法现状,并试图从多方面寻找原因。在此基础之上,尝试从法学理论的视角,以自由权、生育权等法律价值位阶为理论背景,并参考国外关于堕胎权问题的研究,从范围上和程序上两个维度,为我国堕胎权的保障和限制提供理论上的依据、制度上的探索。通过本文的阐述,以期为我国弥补堕胎权的制度空缺问题引发更多人的关注和思考,从而实现生育权与其他权利的平衡发展。
[Abstract]:In recent years, with the continuous proliferation of "abortion" advertisements, "abortion" is no longer the words that once made Chinese people shy and inexplicable. People's concepts have changed, and medical technology has improved. Even economic conditions make voluntary abortion a miniscule "trivial matter." at the same time, violence such as forced abortion is common. Let passive "abortion" endanger human rights. It is precisely such a "trivial matter" which is faced with both the proliferation and the hidden harm, but it is related to the rights of women and the happiness of the family. Social stability and even the future of the nation. And in the face of the lack of legal restrictions on abortion, how to limit the better protection at the same time. This article will start from the concept and characteristics of the right to abortion, combined with the actual situation of our country, analyze the current situation of legislation, law enforcement and judicial status of the protection of abortion rights in China. And try to find the reasons from many aspects. On this basis, from the perspective of legal theory, with the legal value of the right to freedom, reproductive rights and other legal value as the theoretical background, and reference to foreign research on abortion rights. From the two dimensions of scope and procedure, it provides theoretical basis and system exploration for the protection and limitation of abortion right in China. In order to make up for the system vacancy of abortion right in our country, more people pay attention to and think about it, so as to realize the balanced development of reproductive right and other rights.
