论知识产权穷竭的“竭点”——兼议齐爱民教授“制造完成说”

【摘要】：知识产权穷竭的"竭点"构成其逻辑起点,并影响着知识产权的概念界定及对权利穷竭的本质认识。"首次销售说"有其历史功绩,但是又存在法理局限与现实不足。"制造完成说"则能较好地解决相关问题,明晰知识产品上物权与知识产权的时间界限,进而按权利性质划分权利内容,配套以其他机制寻求利益平衡,可以化解权利冲突并促进知识产品国际贸易更加自由公平。
[Abstract]:The "exhaustion point" of exhaustion of intellectual property rights constitutes its logical starting point and influences the definition of the concept of intellectual property and the essential understanding of exhaustion of rights. However, there are limitations of legal theory and lack of reality. "the theory of manufacturing completion" can better solve the related problems, clarify the time limits of real right and intellectual property on knowledge products, and then divide the content of rights according to the nature of rights. Other mechanisms to seek balance of interests can resolve conflicts of rights and promote freer and fairer international trade in intellectual products.
