住宅小区地下车位归属问题研究

【摘要】:我国《物权法》第74条对住宅小区地下车位的归属问题作了概括性规定,但该规定并未解决实践中的地下车位归属问题。专有部分地下车位,满足构造上、利用上的独立性和能够登记成为特定业主所有权的客体这三项条件,能够成为独立交易的标的物,应当根据约定归属说确定原始所有权由开发商取得,之后可以通过当事人不同约定方式由业主所有或者业主使用。共有部分地下车位,如果地下车位的建筑面积作为公摊面积已经分摊到建筑物总面积当中,则该部分地下车位应由全体业主共有。人防工程属性的地下车位,应根据“谁投资、谁所有、谁受益”的规则确定其归属。只有确定地下车位能够作为独立物和明确地下空间使用权,地下车位才能进行权属登记。我国法应当在统一登记机构、登记簿册、登记依据和信息平台的基础上,具体构建地下车位权属登记制度。
[Abstract]:Article 74 of the Real right Law of our country has made the general stipulation to the question of the underground parking space in the residential district, but this stipulation has not solved the problem of the underground parking space in practice. The exclusive part of the underground parking space satisfies the structure. The use of independence and the ability to register as the object of the ownership of a particular owner can become the subject of independent transactions, and the original ownership should be determined by the developer according to the agreed ownership theory. After that, it can be used by the owner or the owner in different ways by the parties. There are some underground parking spaces, if the building area of the underground parking space has been divided into the total area of the building as the common share area. Then this part of the underground parking space should be shared by all owners. The civil air defense engineering properties of the underground parking spaces should be based on "who invested, who owned." Only if the underground parking space can be regarded as an independent object and the right to use underground space can be registered, can the underground parking space be registered for ownership. The law of our country should be in the unified registration institution and the register book. On the basis of registration basis and information platform, the registration system of underground parking space ownership is built concretely.
