绿色技术产业化与专利制度创新问题初探

【摘要】:为实现我国经济更好更快、可持续发展,积极承担应对全球气候变化的国际义务,推广绿色技术、推进绿色技术产业化已是大势所趋。毋庸置疑,知识产权制度,尤其是专利制度是绿色技术研发、推广及产业化的制度保障。然而从实践来看,我国现行专利制度并没能满足为绿色技术产业化保驾护航的需求,相反却可能成为绿色技术发展与应用的障碍之一。绿色技术专利申请大量积压,绿色技术专利质量不佳,专利闲置率高、转化率低等现实因素都严重影响着绿色技术的产业化发展。在环境污染、全球气候变化的大背景下,推进绿色技术产业化发展已刻不容缓,现行专利制度要从以上问题出发加以完善才能真正发挥其制度保障作用,绿色技术产业化繁荣发展的景象才有望呈现。
[Abstract]:In order to achieve a better and faster and sustainable development of our economy, it is a general trend to actively undertake the international obligations to deal with global climate change, to promote green technology and to promote the industrialization of green technology. The intellectual property system, especially the patent system, is the institutional guarantee for the R & D, promotion and industrialization of green technology. China's current patent system has not been able to meet the need to protect the industrialization of green technology, on the contrary, it may become one of the obstacles to the development and application of green technology. The poor quality of green technology patent, high patent idle rate, low conversion rate and other practical factors seriously affect the development of green technology industrialization. Under the background of environmental pollution and global climate change. It is urgent to promote the development of green technology industrialization. The current patent system should be perfected from the above problems in order to give full play to its system guarantee function, and the prosperity and development of green technology industrialization can be expected.
