个体与群体之间的选择：民法价值取向演变的历史探析

【摘要】：本文以民法的发展历程为时间线索,以人们在民事立法和实践活动中对于个体价值取向、群体价值取向的选择为理论线索,展开叙述。在对个体价值取向、群体价值取向、两者之间关系进行法哲学视域下的理论分析的基础上,通过历史的回顾,研究不同历史条件下,民法价值取向选择的现实依据。最后对当代民法价值取向的转换进行探讨。当代民法的价值取向不应该局限在个体与群体之间的选择,而应该归回人本身,突出对于人的保护、对于弱者的保护。本文将民法价值取向的选择范围设定为个人与国家、个人与社会团体、个人与个人之间,而不是简单地以个人价值取向、社会价值取向来表达民法的本位。
[Abstract]:This article takes the development course of civil law as the time clue, takes the choice of individual value orientation and group value orientation in civil legislation and practice activities as the theoretical clue, unfolds the narration. On the basis of the theoretical analysis of the orientation of group value and the relationship between them from the perspective of philosophy of law, through the review of history, this paper studies the different historical conditions. Finally, the conversion of value orientation of contemporary civil law is discussed. The value orientation of contemporary civil law should not be limited to the choice between individuals and groups, but should be returned to the person himself. Focusing on the protection of the human, the protection of the weak. This article sets the choice range of the value orientation of the civil law as individual and country, individual and social group, individual and individual, but not simply individual value orientation. Social value orientation to express the standard of civil law.
