自由贸易园区的知识产权保护研究

【摘要】：自由贸易园区是国家为了推进国际贸易的自由化或为了实现其它特殊经济目标而设立的实施特殊经济政策的园区。自由贸易园区鼓励贸易自由化和贸易便利化,贸易便利化措施的实施一方面能够为园区内传统的货物贸易和新兴的服务贸易提供便利条件,另一方面,通关效率的提高和新兴贸易业态的发展也使得区内的知识产权侵权风险日益突出。然而,自由贸易园区内的知识产权保护包括海关边境执法、区内市场监管体系的完善和纠纷解决模式的多元化等诸多方面的内容,另外,在园区内推行更高标准的知识产权边境执法措施在国际大环境下已是大势所趋。因此,在自由贸易园区内应当明确海关职能并探索对货物的分类监管办法、完善区内实施的二元市场监管模式以及探索区内纠纷解决的多元化路径。
[Abstract]:The Free Trade Park is a special economic policy park set up by the country to promote the liberalization of international trade or to achieve other special economic objectives. The Free Trade Park encourages trade liberalization and trade facilitation. The implementation of trade facilitation measures can, on the one hand, facilitate traditional trade in goods and emerging trade in services within the park, on the other hand. The improvement of the efficiency of customs clearance and the development of new trade formats also make the risk of intellectual property infringement in the region increasingly prominent. However, the protection of intellectual property rights in the Free Trade Park includes customs border law enforcement. The improvement of the regional market supervision system and the diversification of dispute resolution mode, etc., in addition. Implementation of higher standards of intellectual property border enforcement measures in the park has become a general trend in the international context. Therefore, customs functions should be clarified in the Free Trade Park and methods for the classification of goods should be explored. Perfect the dualistic market supervision mode and explore the diversified path of dispute resolution in the region.
