网络服务协议中动态条款的异质性规则与权利平衡

【摘要】：网络服务协议是由网络服务提供者单方面事先拟定的合同形式,应在利益衡量视野下对网络服务协议的特殊规则进行平衡和补充。合同缔结后,网络服务提供者保有对合同条款随时修改的权利,合同地位的平等性要求网络服务协议条款"明示"性要求,保障用户对合同条款合理审阅的权利;明确对用户数据收集和利用的范围,以及再利用和转让的途径和程序,并将其一并进行公示;建立第三方中立组织,对网络服务协议进行协同监管。
[Abstract]:The network service agreement is the contract form which is drawn up by the network service provider in advance. The special rules of the network service agreement should be balanced and supplemented from the perspective of interest measurement. After the conclusion of the contract. Network service providers retain the right to modify the terms of the contract at any time, and the equality of the contractual status requires that the terms of the network service agreement be "expressly" required to ensure the user's right to review the terms of the contract reasonably; To clarify the scope of user data collection and utilization, as well as ways and procedures for reuse and transfer, and to make them publicly available; Establish a third-party neutral organization to coordinate the supervision of network service protocols.
