颜色商标可注册性研究

【摘要】：随着科学技术的突飞猛进和经济的蓬勃发展,以文字、图案等元素构成的传统商标已经不足以满足现代经济活动的需要,包括颜色商标在内的非传统商标越来越多地被人们所采用。与美国、欧盟等先进国家或地区相比,我国的颜色商标相关立法十分滞后,对颜色商标的保护水平也亟待提升。颜色商标分为颜色组合商标和单一颜色商标。虽然与以文字、图案等元素构成的传统商标相比具有一定的特殊性,但只要满足相应的要求,颜色商标同样能够发挥指示商品或服务来源的功能,理应准许注册并给予保护。本文的结构和内容可简要概括如下:首先,对颜色商标的含义及种类做概括性说明,并对国内外颜色商标保护现状做简要介绍;接着,对颜色商标的界定以及权利范围的确定进行讨论;然后,着重从颜色商标的适格性、显著性和非功能性三个方面入手,对颜色商标的可注册性进行较为全面的分析论证;最后,结合我国目前颜色商标立法的缺陷和颜色商标保护实践中出现的问题,就完善我国的颜色商标制度提出建议,希望对我国今后的颜色商标立法及保护实践有所帮助。
[Abstract]:With the vigorous development of science and technology and economy to text, pattern and other elements of the traditional trademark has been insufficient to meet the needs of modern economic activities, including color trademark, non conventional trademarks are increasingly being used by people. Compared with the United States, the European Union and other developed countries or regions, color trademark legislation in China the very slow, the level of protection of color trademark also needs to be improved. The color trademark is divided into single color and color combination trademarks. Although compared to text, pattern elements of the traditional trademark has some particularity, but as long as meet the corresponding requirements, color trademark can also play the function of indicating the source of goods or services that should allow registration and to protect it. The structure and content of this paper can be briefly summarized as follows: firstly, the meaning and types of color trademark do general description, And the status of domestic and international color trademark protection is introduced briefly; then, to define and determine the discussion scope of right color trademark; then, focuses on the suitability of color trademark, three significant and non functional of the color trademark can be analyzed in a comprehensive registration; finally, combined with the defects and color trademark protection practice color trademark legislation in our country at present, put forward suggestions on the improvement of China's color trademark system, hope to the future of China's color trademark legislation and protection in practice.
