人格财产侵害之精神损害赔偿问题探究

【摘要】：在当前的司法实践中,寄托人精神利益的财产所引发的争议越来越大。“人格财产”被从一般意义上的财产中分离出来,日渐进入司法的视野。然而,我国法律并没有对“人格财产”的概念,“人格财产”的判定标准及“人格财产”受侵害能否要求精神损害赔偿等问题做出明确的规定。本文在参考了众多文献资料及相关外国立法的基础上,结合我国立法的现状试图对如何定义“人格财产”的概念,“人格财产”的特征有哪些,“人格财产”的评判标准是什么,及侵害“人格财产”的表现形式及适用精神损害赔偿的依据做出一个详细的阐述,以求探寻完善“人格财产”法律保护的有效途径。本篇文章共分为四个部分,分别是人格财产侵害概述,人格财产侵害能够主张精神损害赔偿的正当性分析,人格财产侵害之精神损害赔偿的法律规定及存在问题,完善人格财产法律保护之建议。文章第一部分重点介绍了“人格财产”的概念、特征和评判标准及侵害人格财产的表现形式。文章第二部分则论述了精神损害赔偿的功能及请求赔偿的理论依据和现实依据。文章的第三部分介绍了国内外的相关立法规定,并对这些规定进行了简单的评析。文章的第四部分试图从责任承担类型,请求主体及赔偿数额的认定等方面提出完善“人格财产”法律保护的合理化建议。
[Abstract]:In the current judicial practice, the disputes caused by the property entrusted to the spiritual interests of the susignor are becoming more and more serious. "personal property" has been separated from the property in the general sense and gradually entered the judicial field of vision. The concept of "personality property", the judgment standard of "personality property" and the question of whether "personality property" being infringed to demand compensation for spiritual damage are not clearly stipulated in Chinese law. This paper refers to many documents. On the basis of the relevant foreign legislation, According to the present situation of our country's legislation, this paper tries to define the concept of "personality property", what are the characteristics of "personality property", and what is the criterion of "personality property". In order to explore the effective way to perfect the legal protection of "personality property", this article is divided into four parts. It is an overview of personal property infringement, an analysis of the legitimacy of personality property infringement to claim compensation for mental damage, the legal provisions and existing problems of compensation for moral damage caused by personality property infringement. The first part of the article mainly introduces the concept of "personal property". The second part discusses the function of mental damage compensation and the theoretical and practical basis of requesting compensation. The third part of the article introduces the domestic and foreign relevant legislation. The 4th part of the article tries to put forward some reasonable suggestions to perfect the legal protection of "personality property" from the aspects of the type of responsibility, the subject of request and the amount of compensation.
