【摘要】：本文以农地经营权的物权化为核心,立足于中央文件的改革精神,结合农村土地承包经营权流转过程中普遍产生的问题,分析论述将农地经营权定义为用益物权的合理性,同时对与之配套的权利行使机制和登记制度提出立法建议。文章首先对关于农地"三权分置"的三个政策性文件进行了提炼、分析和解读,并且结合实践分析农村土地承包经营权分离出农地经营权所具有的现实意义以及这一项新的权利有可能面临的法律问题。在对将农地经营权定性为债权的观点进行批驳的基础上,从突破传统用益物权理论出发,为农地经营权的物权化寻求理论依据。论文先对学者们通常认为的农地经营权物权化与一物一权原则冲突的观念进行阐释,接着论证物权法定原则并不意味着阻碍一切新的物权种类产生,而是要在相互融合的基础上进行探索与创新,以此说明将农地经营权设定为一项新型的用益物权是完全可行的。最后论文以此为基础分析农地经营权取得、灭失及权利的内容,结合现有制度资源论证农村土地承包经营权与农地经营权分离登记的可行性,在坚持建立农地经营权登记生效主义的基础上,对具体的登记类型、登记机关、登记流程进行了阐述。
[Abstract]:Based on the spirit of the reform of the central documents and the common problems in the circulation of the rural land contractual management right, this paper discusses the rationality of defining the farmland management right as the usufruct right, taking the real right of farmland management as the core, and based on the spirit of the reform of the central document. At the same time, it puts forward legislative suggestions on the corresponding right exercise mechanism and registration system. Firstly, the article abstracts, analyzes and interprets three policy documents about farmland "three rights division". It also analyzes the practical significance of separating rural land contractual management right from farmland management right and the legal problems that this new right may face. On the basis of line refutation, In order to break through the traditional usufruct theory and seek the theoretical basis for the rem of farmland management right, the paper first explains the concept of the conflict between the principle of one thing, one right and the real right of the farmland management right, which is generally considered by scholars. Then it proves that the principle of the law of real right does not mean to hinder the emergence of all new kinds of real right, but to explore and innovate on the basis of mutual integration. It is feasible to set up the farmland management right as a new kind of usufruct right. Finally, the paper analyzes the content of farmland management right acquisition, loss and right. Combining with the existing system resources to demonstrate the feasibility of separate registration of rural land contractual management right and farmland management right, on the basis of persisting in establishing the effective principle of farmland management right registration, the specific registration type, registration authority, The registration process is described.
