个人信息权确立的双重价值——兼评《民法总则》第111条

【摘要】：法是价值与秩序的统一,《民法总则》第111条的确立,将个人信息权益首次纳入民法保护,使个人信息权在民法层面得以确立。个人信息权的确立具有价值层面和规范层面的双重价值。在价值体系层面,该条款体现了民法对个人信息所具有的多元价值的纳入,属于民法价值体系的扩容;在规范体系层面,通过对宪法层面和部门法层面的教义学考察,能够发现个人信息权已经具备了作为一项独立权利存在的法教义学基础。在当前社会环境下,个人信息具有的人格和财产价值足以支撑其作为一项独立的权利存在。
[Abstract]:Law is the unity of value and order. Article 111 of the General principles of Civil Law establishes the protection of personal information rights and interests in civil law for the first time. The establishment of the right to personal information has the dual value of both the value level and the normative level. At the level of value system, this article embodies the incorporation of the multiple values of the civil law on personal information. It belongs to the expansion of the value system of civil law, and at the level of normative system, through the investigation of dogmatics at the level of constitution and branch law, It can be found that the right to personal information already has the legal doctrinal foundation of existence as an independent right. In the current social environment, the personal information has the personality and property value enough to support its existence as an independent right.
