商品房团购的风险及规制

【摘要】:随着国家对于房产大调控格局的显现,商品房团购受到不少购房者的热捧。商品房团购中法律关系复杂,团购行业缺乏统一的法制规范,实务中往往难以界定主体的法律责任,因此购房纠纷频发。本文从民法理论角度对商品房团购法律关系进行分析,并对商品房团购的风险以及风险规制进行研究,就如何完善商品房团购提供一些切实可行的方法。本文由四部分构成,具体如下:第一部分为单位组织商品房团购特有的风险及规制。通过对单位组织商品房团购相关的法律关系进行分析,针对目前频发的单位购房指标转让风险、单位团购预售以及资金风险,本部分提出相对应的风险防范措施。第二部分为网站组织商品房团购特有的风险及规制。通过对网络团购商品房的法律关系进行分析,对存在的网络团购虚假优惠风险、团购网站市场准入制风险等进行整理和归纳,本部分提出规范网络团购发展的方法。第三部分为消费者自行组织的商品房团购特有的风险及规则。从理论和司法实践的角度,通过分析消费者自行组织的团购中的法律关系,明确团体的法律责任,做好法律风险防范。第四部分为团购模式购房共有的风险及规则。通过分析几种团购模式的共性风险,针对团购资金监管不力、团购维权举证困难等常见的问题,提出进一步完善相关立法、建立购房后续管理机制和信用保障机制、建立有效预付资金的管理制度等措施来完善商品房团购的相关制度。
[Abstract]:With the emergence of the national real estate regulation and control pattern, group purchase of commercial housing is popular with many buyers. The legal relationship in group purchase of commercial housing is complex, the group purchase industry lacks unified legal norms, and it is often difficult to define the legal responsibility of the main body in practice. This paper analyzes the legal relationship of group purchase of commercial housing from the angle of civil law, and studies the risk and risk regulation of group purchase of commercial house. How to improve the group purchase of commercial housing provides some practical methods. This paper is composed of four parts. The main contents are as follows: the first part is the specific risk and regulation of unit organized group purchase of commercial housing. Through the analysis of the legal relationship related to unit organized group purchase of commercial house, the paper aims at transferring the risk of unit purchase index, which is frequently occurring at present. This part puts forward the corresponding risk prevention measures. The second part is about the special risks and regulations of organizing group purchase of commercial housing on the website. Through the analysis of the legal relationship of online group purchase of commercial housing, this part puts forward the corresponding risk prevention measures. Collating and summing up the existing network group purchase false preferential risk, group purchase website market access system risk and so on, This part puts forward the method of standardizing the development of online group purchase. The third part is about the special risks and rules of group purchase of commodity house organized by consumers. From the angle of theory and judicial practice, through analyzing the legal relationship of group purchase organized by consumers themselves, Make clear the legal responsibility of the group, do a good job to prevent the legal risk. 4th part is the common risk and rule of the group purchase mode. By analyzing the common risks of several group purchase modes, the supervision of the group purchase funds is weak. This paper puts forward some common problems, such as the difficulty of proving the rights of group purchase, and puts forward some measures to perfect the relevant system of group purchase of commodity housing, such as further perfecting the relevant legislation, establishing the follow-up management mechanism and the credit guarantee mechanism, and establishing the effective management system of prepaid funds.
