农村土地经营权市场化流转的探讨

【摘要】：党的十八届三中全会通过的《中共中央关于全面深化改革若干重大问题的决定》(以下简称《决定》)中,明确了赋予农民以土地为主的财产权利,是我国农村土地制度历史性突破。全球信息化时代的呼声,促使国家经济快速发展;社会结构的优化转型,催生了法治时代下农村土地经营制度的创新性改革。农地产权制度的完善与农户土地财产权的明晰,印证法治社会下农户权利的政策支持与法律保障。而土地所有权、承包权与经营权的分置,亦进一步推动农地财产物权化、市场化流转。然而,如何在宏观土地政策“有形手”的指引下,将农村土地经营权融入市场这只“无形手”当中,不断深化农业经济新型时代的改革,使其集约化、规模化发展,值得思索与探讨。本文在坚持农村集体土地所有权性质的前提下,运用法学理论与实践相结合的方法,探讨农村土地承包权与经营权相分离有关问题,厘清农村承包土地流转的特殊性,阐明经营权固有的用益物权属性与物权性流转的市场效益。通过对土地现状困境的描述,探索农村土地经营权市场化流转的路径,诠释农民承包土地所蕴含的财产性权利。同时,借鉴国内外科学合理的农地流转制度,契合公权与私权的法律制度,使社会资源“物尽其用”,从而不断完善我国新型农地经营权流转制度。

This paper based on the rural collective land ownership, the law using the method of combination of theory and practice, some problems on the rural land contract right and management right are separated, clarify the particularity of rural land circulation. The right to operate, to clarify the inherent attribute of usufructuary right and property right transfer market efficiency. Based on the current situation of land situation description, explore the path of rural land management rights transfer market, the interpretation of farmers' land contract contains property rights. At the same time, from the domestic and foreign scientific and reasonable land circulation system, the legal system of public power and fit right, so that social resources "make", so as to continuously improve the circulation model of China's agricultural land management right system.
