【摘要】：我国当前信用卡交易市场日益活跃。信用卡作为一种支付工具,已经越来越被广大消费者所接受。随着信用卡的使用普遍化,信用卡交易也越来越活跃。伴随我国信用卡交易市场的不断发展,在此过程中也逐渐产生许多交易纠纷问题。在此现状下,探究信用卡交易制度、理清信用卡交易民事法律关系、完善对持卡人合法权益的保护对稳健发展信用卡交易市场具有积极作用。本文在内容结构上总共划分为四个部分。第一部分是信用卡交易概述。了解信用卡和信用卡交易的基础理论是研究信用卡交易民事法律关系的基础,所以,笔者首先对信用卡交易的基础知识做了相关介绍。第二部分是对信用卡交易民事法律关系各方主体的介绍。由于信用卡交易性质特殊,所涉主体较多,这在一定程度上加大了我们研究信用卡交易民事法律关系的难度。然而,各方交易主体是建立信用卡交易各个具体民事法律关系的前提,笔者在第二部分主要剖析了信用卡交易的各方主体,这为本文分析信用卡交易民事法律关系奠定了基础。第三部分是对信用卡交易民事法律关系的具体分析。信用卡交易各方主体较多,随之产生多个具体民事法律关系,各个民事法律关系之间盘综复杂。在这一部分,笔者先对信用卡交易民事法律关系的结构作了划分,然后依次分析各个具体民事法律关系的主要内容。第四部分是探究我国信用卡交易民事法律关系中存在的主要问题及相关立法建议。近年来,许多学者都投身于信用卡交易民法问题研究。其中,信用卡交易民事法律关系成为研究重点。在梳理信用卡交易民事法律关系之后,我们不难发现,我国当前信用卡交易民事法律关系中还存在诸多问题。笔者分析了当前我国信用卡交易民事法律关系中存在的缺陷,进而从立法的角度提出自己个人完善建议。
[Abstract]:The credit card is becoming more and more active in China's credit card market. As a payment tool, credit card has been accepted by more and more consumers. With the continuous development of the credit card market in China, there are also a lot of transaction disputes in the process. In this situation, we explore the credit card trading system. Clarifying the civil legal relationship of credit card transactions and perfecting the protection of the legitimate rights and interests of cardholders will play a positive role in the steady development of the credit card trading market. The content structure of this paper is divided into four parts. The first part is an overview of credit card transactions. Understanding the basic theory of credit card and credit card transactions is the basis of the study of the civil legal relationship of credit card transactions, so the author first makes a related introduction to the basic knowledge of credit card transactions. The second part is the introduction of the parties involved in the civil legal relationship of credit card transactions. Because of the special nature of credit card transactions, there are many subjects involved, which to some extent makes it more difficult for us to study the civil legal relationship of credit card transactions. In the second part, the author mainly analyzes the main parties of credit card transactions, which lays a foundation for the analysis of the civil legal relationship of credit card transactions. The third part is the specific analysis of the civil legal relations of credit card transactions. There are many parties involved in credit card transactions, resulting in a number of specific civil legal relationships. The author first divides the structure of the civil legal relationship of credit card transaction, and then analyzes the main contents of each specific civil legal relationship in turn. Part 4th is to explore the main problems in the civil legal relationship of credit card transactions in China and related legislative advices. In recent years, many scholars have devoted themselves to the study of the civil law issues of credit card transactions. The civil legal relationship of credit card transactions has become the focus of research. After combing the civil legal relationship of credit card transactions, it is not difficult to find that, There are still many problems in the civil legal relationship of credit card transaction in our country. The author analyzes the defects in the civil legal relationship of credit card transaction in our country, and then puts forward his own personal suggestions from the angle of legislation.
