【摘要】：涉大型超市零供关系这个名词目前对于普通大众来讲可能有点陌生,但是其产生已经有段时间了,而且目前正在以各种形式如火如荼的发展。涉大型超市零供关系从某种程度来讲可以说是法律上一种新型的关系,而且随着我国目前的零售和供应行业不断的扩大,使这种关系在法律上越来越多的表现出来。涉大型超市可以说是目前中国最具朝气,如一股新鲜血液一样给社会经济带来了活力。它不仅从供销环节上激活了经济,同时也促进了自然、人才、资金和技术等各种资源的合理配置,甚至可以说它在某种程度上影响着经济的健康有序发展。然而,大型超市只是一个表象,其实起关键决定作用的正是其所承载的零售商与供应商之间的关系。本文以涉大型超市零供关系作为对象进行深入地研究和探讨,将在法律层面上,结合实践中经常遇到的问题,提出笔者自己的看法。文章从前到后循序渐进地阐述涉大型超市零供关系的历史沿革和现状,重要的地位和意义。在综合分析其法律性质的基础上,笔者从实体和程序两方面对涉大型超市零供关系中产生的问题提出了自己的观点并给出了处理原则。综上,为解决零供关系这种新型关系中存在的法律问题,笔者结合我国目前的司法现状,以及现有法律规范,作以思考和尝试,以供立法者和学者们在研究零供关系时参考。
[Abstract]:The term "zero supply relationship" involved in large supermarkets may be a bit unfamiliar to the general public at present, but it has been around for some time. And at present, it is developing in full swing in various forms. To some extent, the zero-supply relationship involving large supermarkets can be said to be a new type of legal relationship, and with the expansion of the current retail and supply industries in our country, This relationship has become more and more legal. The supermarkets involved are now the most vigorous in China, bringing vitality to the social economy like a new blood. It not only activates the economy from the supply and marketing links, At the same time, it also promotes the rational allocation of various resources, such as nature, talent, capital and technology, and can even be said to affect the healthy and orderly development of the economy to some extent. In fact, it is the relationship between retailers and suppliers that plays a decisive role. This paper takes the zero-supply relationship of large supermarkets as the object for in-depth study and discussion, which will be on the legal level. In combination with the problems often encountered in practice, the author puts forward his own views. The article expounds the historical evolution and present situation of zero-supply relationship in large supermarkets step by step from front to back. On the basis of the comprehensive analysis of its legal nature, the author puts forward his own views on the problems arising from the zero-supply relationship in large supermarkets from the aspects of entity and procedure. In order to solve the legal problems existing in the new relationship of zero-supply relationship, the author combines the current judicial situation of our country and the existing legal norms to think and try for the reference of legislators and scholars in the study of zero-supply relationship.
