【摘要】：文学艺术作品蕴含了作者的文化涵养、一个时代的文学底蕴,一部好的文学作品,甚至具有极高的文学价值,可以穿越时空、跨越种族文化,其精神力量可以影响千千万万的人。然而,酒香也怕巷子深,一部好的作品,如果有人加以包装或推广,必然会促进其传播和影响力。从以前的戏曲、说书到现代的电视、电影,都是作品转播的过程。演员或歌手介入到作品的传播过程中来,推动了文学艺术的传播和人类文明的发展。术业有专攻,表演也是如此。一场完整的演出背后,是表演者专业的表演技艺和日复一日的勤学苦练,他们利用自己的特长,把优秀的文学艺术作品呈现出来,使作品能够更多的人知道和喜爱。在某种程度上,在传播作品的同时,表演者自身也是收获了专业上的进步和社会大众的喜爱,这就是表演和文学为什么分不开的道理,它们是相辅相成的。表演者权利内容的丰富多样与侵权渠道层出的现状值得立法者进行思考:怎样在立法上完善表演者权保护体系,解决日益增多的利益纠纷。随着粉丝群体的出现,这个问题不仅仅是时代的要求,也成为了民众的呼声。从表演者权的缘起和变化,再到海内外的立法实践,最后感受到我国著作权法中的不足之处和可取之处,为我国表演者权保护体系的生成建言献策。依据这种思路,从立法者和表演者两方的角度审视我国的著作权立法现状,思考我国对在预防和解决此类纠纷时存在的问题,进一步提出相关的观点和意见,希望能促进我国著作权的进一步完善、维护表演者的根本利益。
[Abstract]:Literary and artistic works contain the cultural preservation of the author, the literary background of an era, a good literary work, and even a very high literary value, which can travel through time and space and span ethnic culture. Its spiritual power can affect thousands of people. However, wine fragrance is also afraid of deep alleyways. A good work, if it is packaged or popularized, will certainly promote its dissemination and influence. From previous operas and storytelling to modern television, Movies are all the process of broadcasting works. Actors or singers get involved in the process of transmission of works, which promotes the spread of literature and art and the development of human civilization. There is a specialty in the art industry, and so is the performance. Behind a complete performance, It is the professional performance skills of performers and the hard work and practice day after day. They make use of their specialties to present outstanding works of literature and art, so that more people can know and like them. To a certain extent, While disseminating works, the performers themselves have also gained professional progress and the love of the general public. This is why performance and literature cannot be separated. They complement each other. The rich and diverse content of performers' rights and the current situation of infringement channels are worthy of consideration by legislators: how to perfect the system of protection of performers' rights in legislation, To resolve an increasing number of interest disputes. With the emergence of fans, this issue has become not only a requirement of the times, but also a voice of the public. From the origin and changes of performers' rights to legislative practice at home and abroad, Finally, I feel the shortcomings and the merits of the copyright law of our country, and make suggestions for the formation of the system of the protection of performers' rights in our country. According to this way of thinking, from the angle of legislator and performer, we examine the present situation of copyright legislation in our country. In order to promote the further improvement of copyright and safeguard the fundamental interests of performers, this paper thinks about the problems existing in the prevention and settlement of such disputes in China, and puts forward some related viewpoints and opinions.
