我国占有制度研究

【摘要】：占有是日常生活中最常见的一种对物的支配状态,作为一种民法制度的历史最早可追溯至罗马法时期。自其产生至今,虽一直被认为是人类历史上浩繁复杂、晦涩艰深、争议最大的民事法律制度之一,但在经历罗马法上的Possessio和日耳曼法上的Gewere的融合,仍在德国、日本、瑞士等大陆法系国家（地区）的民法典中得以保存和发展。主要原因在于占有制度具有维护社会秩序、保障交易安全等重要价值。而我国出于特殊国情,一直把占有规定为所有权的一项权能之一,未能引起立法者的足够重视,未能建立独立、完善的占有制度。随着市场经济的快速发展,为满足司法实践需要,快速有效地解决现实生活中因占有引起的争端,我国2007年颁布了《物权法》,将占有单列一编,设在总则、所有权和他物权之后,虽只有简单的5个法条,仍标志着我国占有制度的正式建立,意义重大。但是占有制度本身就是一个饱受争议的制度,我国占有制度在立法上的单薄和不完善,更招致批评不断。因此,有必要对我国占有制度进行重新审视。本文在结构上分为五个部分,其主要内容为:第一部分先简单介绍了占有制度研究背景,着重描述了我国占有制度研究的价值意义;第二部分介绍了占有制度的基本理论;第三部分着重阐述了在大陆法系国家（地区）或地区的立法实践中,德国、日本、瑞士及台湾地区的民法典中有关占有制度的立法规定;第四部分试图通过对我国物权法中的占有制度进行立法考察,并对占有制度的占有构成要件、占有分类、占有推定、占有人的权利义务及占有保护等方面进行分析研究,以找出缺失和不足;第五部分对我国占有制度的不足提出完善建议。
[Abstract]:Possession is the most common state of domination of things in daily life, and the history of a civil law system dates back to the Roman law period. One of the most controversial civil law systems, but still in Germany, Japan, where the Possessio in Roman law and Gewere in Germanic law merged. The main reason for the preservation and development of the civil code in countries (regions) of civil law such as Switzerland is that the possession system has the important value of maintaining social order and ensuring the security of transactions. The regulation of possession has always been regarded as one of the powers of ownership, which has not attracted enough attention from legislators and failed to establish an independent and perfect possession system. With the rapid development of the market economy, in order to meet the needs of judicial practice, In 2007, our country promulgated the Real right Law, which is a separate part of possession, after the general principles, ownership and other real right, although there are only five simple articles of law. It still marks the formal establishment of the possession system in our country, which is of great significance. However, the possession system itself is a controversial system, and the legislation of the possession system in our country is weak and imperfect, which leads to constant criticism. It is necessary to re-examine the possession system of our country. This paper is divided into five parts in structure. The main contents are as follows: the first part briefly introduces the background of the research on the possession system, emphatically describes the value significance of the study of the possession system in our country; The second part introduces the basic theory of the possession system, the third part focuses on the legislative provisions of the possession system in the civil code of Germany, Japan, Switzerland and Taiwan in the legislation practice of the countries (regions) of the continental law system. The 4th part attempts to make a legislative investigation on the possession system in the property law of our country, and analyzes and studies the constitution, classification, presumption, the rights and obligations of the possessor and the protection of the possession of the possession system. In order to find out the deficiencies and deficiencies; 5th part of the inadequate possession system in China to put forward some suggestions.
