“一车二卖”情形下物权归属问题的研究

【摘要】：我国《物权法》确立如下规则,基于法律行为发生的物权变动的物权归属,动产物权变动为交付生效主义,不动产物权变动为登记生效主义。机动车因其特殊性质与一般动产稍有不同。第二十四条规定,机动车等特殊动产的物权变动,完成交付就能使物权变动生效,但当事人可同时选择登记确权,从而使物权具有能够对抗善意第三人的效力。2012年最高人民法院审理买卖合同纠纷解释公布后,引起了人们的争议。针对前后法律令人疑惑的地方,本文从"一车二卖"的情形入手,围绕当前争议的问题、物权归属的确认,登记对抗的意义以及该情形下善意第三人等问题进行论述。
[Abstract]:The property Law of our country establishes the following rules, based on the ownership of the real right change of the legal act, the property right change of movable property is the doctrine of delivery and effectuation. The real right change of immovable property is the doctrine of registration and effectuation. Because of its special nature and general movable property, motor vehicle is slightly different from ordinary movable property. According to Article 24th, when the real right of motor vehicle and other special movable property changes, the completion of delivery can make the real right change take effect. However, the parties may at the same time choose the right to register and confirm the right, so that the real right can be effective against a bona fide third party. After the Supreme people's Court heard the interpretation of the dispute over the sale contract in 2012, This article starts with the situation of "one car and two sell", around the current controversial issue, the confirmation of the ownership of real right. The significance of registration confrontation and the issue of bona fide third party in this case are discussed.
