业主团体自治

【摘要】:业主团体是我国进行房改之后出现的一个新概念,实际上是小区各个业主为了实行个人利益和共同利益聚集起来管理小区事务的组织。各国立法对此有着不同的称谓,法国《住宅分层所有权法》称之为协同管理团体;德国《住宅所有权法》称之为住宅所有权人共同关系团体,即住宅所有人共同体;日本《建筑物区分所有权法》将业主团体按性质的不同分为三类:管理团体、管理组合法人及社区管理团体。虽然各国立法的称谓不同,但它的出现无疑对各国民法特别是建筑物区分所有权领域有着重大的意义。上世纪80年代商品房市场化趋势逐渐加强,各城市小区的数量、规模呈扩张的态势,人们的居住方式发生了巨大的变化,由以往独门独院的居住方式演变为聚集在一起的生活方式。业主购买小区的房产后,除了需要处理专有部分所有权的关系,还因为共用部分的存在需要处理与其他业主的关系即共用部分持份权。这种不同于以往的法律关系的出现为使得小区的管理更具复杂性。本文运用比较分析、实证研究的方法,从业主团体自治的相关概念入手,叙述业主团体进行管理需要遵守的原则和发挥的作用,然后运用政治学、社会学、民法学理论分析其理论的正当性,同时结合国外立法论述其自治的内容,包括进行管理的内容、业主公约、业主团体的运行等内容,在上述理论的基础上分析我国当前业主团体自治所面临的一系列问题,如业主团体法律定性的缺失、业主团体与物业公司的关系定位不当等问题。通过揭示我国业主团体自治存在的不同问题,提出相关建议和措施,以期能够丰富其理论,解决实践中出现的部分问题,充分发挥出业主团体在私法领域的功能和作用。
[Abstract]:The owners group after China's housing reform is the emergence of a new concept, is actually the plot each owners to implement individual interests and the common interests together the management of district affairs organization. Although the legislation title, but it's undoubtedly of civil law especially buildings the distinction between ownership of the field is of great significance. The trend of the last century in 80s the real estate market gradually strengthened, the number of the city area, the scale is expanding trend, people Great changes have taken place in the way of living, evolving from the previous single family living together for life. The owners to purchase residential real estate, except to deal with exclusive part of the ownership, but also because part of the shared relationship between the need to deal with other owners that share holders of rights. This is different in the past the legal relationship in order to make the community management more complicated. This paper uses comparative analysis, empirical research methods, starting from the relevant concepts of the owners of autonomous group, the owners group management should abide by the principles and the role and use of political science, sociology, analysis the legitimacy of its theory of civil law the theory, combined with foreign legislation and discusses its autonomous content, including the content of the management, the Convention on the owners, owners group operation etc., in the theoretical basis Analysis of a series of problems in China's current owners autonomous group facing the basis, such as the lack of legal owner group qualitative, positioning the relationship between owners and property companies group improper. By revealing the different problems of our owners autonomous group, puts forward relevant suggestions and measures, in order to enrich the theory and solve the problems arising in practice, give full play to the function and role of the owners group in the field of private law.
