关于一房二卖若干法律问题研究

【摘要】:随着经济的发展,房地产行业呈现蓬勃发展的景象,一房二卖的现象也愈来愈多。一房二卖具有多种表现形式,不同的表现形式房屋所有权归属判断不同,文章主要研究的是出卖人将房屋出卖给两个买受人,一方完成登记,另一方完成交付这一种情况。出卖人将房屋出卖给第一买受人之后又将房屋出卖给第二买受人,各个买卖合同都是有效的,房屋所有权归属于登记的一方。在这一交易中,第一买受人与第二买受人相比双方的权利义务不成比例。第一买受人不仅需要支付购房款,还需要承担房屋毁损灭失的风险,但第一买受人最终无法取得房屋所有权,他虽占有房屋却也只是形式所有权人。第二买受人只需要支付购房款,第二买受人不承担房屋毁损灭失的风险。第一买受人未得到房屋可以请求出卖人承担违约责任和不超过已付房款一倍的赔偿金,但是这些保护措施各有各自的缺点需要进行完善。为更好保护第一买受人利益,在物权法上一方面可以完善预告登记制度,另一方面可以对部分特殊的房屋实行以占有推定所有权。在合同法上第一、可以引入西方国家的获益交出权;第二、可以加大违约损害赔偿请求权的赔偿力度,将第二次买卖的价格作为赔偿的范围;第三可以修改房屋买卖合同司法解释的一些条款。
[Abstract]:With the development of economy, the real estate industry is developing vigorously, and the phenomenon of "one house and two selling" is becoming more and more. This article mainly studies the situation that the seller sells the house to two buyers, one party completes the registration and the other party completes the delivery. The seller sells the house to the first buyer and then sells the house to the second buyer. Each contract of sale and purchase is valid, and the ownership of the house is vested in the registered party. In this transaction, the rights and obligations of the first buyer are disproportionate to those of the second buyer. The first buyer not only has to pay for the purchase, There was also the risk of damage and loss of the house, but the first buyer was unable to acquire the ownership of the house, which was only the formal owner. The second buyer only had to pay for the purchase. The second buyer does not bear the risk of damage and loss of the building. The first buyer who fails to receive the building may request the seller to bear the liability for breach of contract and not more than twice the amount paid for the house, In order to better protect the interests of the first buyer, on the one hand, the notice registration system can be improved in the property law. On the other hand, some special houses can be assumed to have the right of ownership. In the contract law, first, the right of profit surrender can be introduced into the western countries; second, the compensation for the right to claim damages for breach of contract can be increased. Take the price of the second sale as the scope of compensation; third, amend some of the provisions of the judicial interpretation of the house sale contract.
