【摘要】:随着信息时代的迅猛发展及互联网技术的日新月异,使得数字技术也在不断的改变着人们的学习、工作、生活及娱乐方式,并深刻地推动着著作权法律制度的近一步完善。而随着互联网宽带、移动数字技术的高速发展和普及,人们在畅享数字生活的高效便捷的同时,以数字音乐作品著作权人为代表的新型著作权所有者也面临法律本身固有的滞后性所带来的法律法规及制度的缺失而侵害其本身合法权益的威胁。数字音乐作品在此次浪潮中,正处于变革和调整之际。数字技术的开放性、交互性及无限复制性使得对我国的数字音乐作品的著作权许可研究需要更近一步深化和完善。其紧迫性已经达到了前所未有的高度。在数字技术作品的著作权许可及保护制度中,我国长期以来存在管理体制分散及管理力度不够的问题。除了要在数字技术客体的自身技术层面上作出提高和努力以外,在对著作权许可方面的研究也要与时俱进。现实社会是法制的社会,由数字技术作品构成的网络社会也应当是法制社会。而传统的著作权保护制度(“一对一”)的授权模式因为效率低下如今很难适应数字技术发展所带来的冲击,无法及时有效的保护著作权人的合法权益,难以维系数字技术作品的著作权人、使用者及传播者之间的利益平衡。为了满足及保护数字技术作品著作权人的创作积极性及合法利益,也为了更好地满足广大数字技术作品使用者的需求,从而减少双方在使用数字音乐作品时所产生的矛盾,对数字音乐作品的著作权许可研究具有十分重要的现实意义。本文利用价值分析法、比较分析法等方法,在研究著作权法许可制度的原理的基础上,对我国数字音乐作品著作权规定及保护方面的实际情况及突出问题进行分析,在对比西方发达国家和地区在数字音乐作品著作权许可制度方面的先进理论和制度的基础上,对我国数字音乐作品著作权许可制度进行研究,最后,在利益平衡原则的指导下,从法定许可、强制许可及集体管理组织等方面对我国数字音乐作品著作权许可制度提出了具体的完善建议。
[Abstract]:With the rapid development of the information age and the rapid development of Internet technology, digital technology is constantly changing the way people learn, work, live and entertain. With the rapid development and popularization of Internet broadband and mobile digital technology, people enjoy the high efficiency and convenience of digital life at the same time. The new type of copyright owners, represented by the copyright owners of digital music works, are also faced with the threat of the lack of laws, regulations and systems brought about by the inherent lag of the law itself and the infringement of their own legitimate rights and interests. At a time of change and adjustment. The openness of digital technology, Interactivity and unlimited reproduction make the research on copyright license of digital music works in our country need to be further deepened and perfected. Its urgency has reached an unprecedented height. In the system of accessible protection, For a long time, China has the problems of decentralized management system and insufficient management dynamics. Besides, it is necessary to improve and make efforts on the technical level of the object of digital technology. The research on copyright licensing should also keep pace with the times. The network society composed of digital technology works should also be a legal society. However, the traditional authorization mode of copyright protection system ("one-to-one") is difficult to adapt to the impact of the development of digital technology because of its inefficiency. Unable to protect the legitimate rights and interests of the copyright owner in a timely and effective manner and to maintain the copyright owner of a digital technical work, Balance of interests between users and communicators. In order to satisfy and protect the creative enthusiasm and legitimate interests of copyright owners of digital technology works, and to better meet the needs of the majority of users of digital technology works, In order to reduce the contradiction between the two parties in using digital music works, it is of great practical significance to study the copyright license of digital music works. On the basis of studying the principle of copyright law licensing system, this paper analyzes the actual situation and prominent problems of copyright regulation and protection of digital music works in China. On the basis of comparing the advanced theories and systems in the copyright licensing system of digital music works in western developed countries and regions, this paper studies the copyright licensing system of digital music works in China. Finally, under the guidance of the principle of balance of interests, From the aspects of legal license, compulsory license and collective management organization, the author puts forward some concrete suggestions on the copyright licensing system of digital music works in China.
