【摘要】:由于人格权的禁止转让,人格要素的商业化利用只能采取权利人"同意"或许可使用的方式,它仅具有债权的效力,不符合现代社会对人格要素使用的要求。物权法上的创设定限物权的权能分离理论,对人格权的商业化利用具有借鉴价值:借助科学技术,人格要素的商业使用具有"客体化"的可能,人格权包含了积极的使用、收益权能,且人格权与所有权同为支配权。商品化人格权的定限转让,创设了一个具有物权性质的人格权使用权;它的内容主要根据当事人的意思自治决定,因为具有特定的公示性,人格权使用权并不会造成对第三人自由的过分限制。
[Abstract]:Due to the prohibition of the transfer of personality rights, the commercial use of personality elements can only be "agreed" or permitted by the obligee.
