网络环境下的合理使用制度研究

【摘要】：合理使用制度在我国著作权法中,是一项非常重要的法律制度。它是指在著作权法中有明文规定的前提下,使用他人的作品可以不经过著作权人的许可,并且无需向其支付报酬。合理使用制度一直以来被认为是著作权法中的一个十分复杂的问题,在现代的网络环境下这个问题更是带来了很大的冲击。各个国家都在不断积极地探索在网络环境下如何构建合理使用制度的,我国对于网络环境下的合理使用制度规定目前还不够完善。本文的目的是在借鉴国外相关经验的基础上,提出一些完善我国网络环境下的著作权合理使用制度的思路。本文共分成五个部分。绪论部分介绍了课题的研究背景及意义,并且简要说明了国内外研究现状以及本文的研究方法。正文主要从以下几个部分展开论述:第一章主要介绍合理使用制度的概述,分别阐述了合理使用制度的起源与发展、合理使用制度的定义以及合理使用制度的特征。第二章主要介绍网络环境对于合理使用制度带来的冲击,主要包括了著作权人权利的扩张、技术保护措施对合理使用制度的冲击以及对“个人合理使用”的冲击。第三章主要介绍国际条约、一些发达国家如美国、英国、德国,以及我国对于网络环境下合理使用制度的相关规定。第四章中,对于我国网络环境下合理使用制度的完善从立法模式和网络时代合理使用制度的新发展两个方面提出了一些建议。
[Abstract]:The fair use system in the copyright law in China, is a very important legal system. It refers to the premise expressly stipulated in the copyright law, the use of the works of others without the permission of the copyright holder, and without payment of remuneration to it. The rational use of the system has long been considered a very complex issue in copyright law, in the modern network environment has brought great impact. Each country has been actively exploring in the network environment how to construct the system of fair use, China's regulations for the network environment reasonable use system is still not perfect in this paper. The purpose is on the basis of relevant experience abroad, put forward some improvement of the fair use system under the network environment in China Copyright ideas. This paper is divided into five parts. The introduction part introduces the topic of the research Research background and significance, and briefly describes the research situation at home and abroad and the research methods. The text mainly discusses from the following parts: an overview of the rational use of the system are introduced in the first chapter, respectively expounds the origin and development of the system of rational use, reasonable use system definition and characteristics of the rational use of the system. In the second chapter mainly introduces the network environment for the rational use of the system's impact, including the expansion of the copyright, technology protection measures for the rational use of the system and the impact of "fair use" personal impact. The third chapter mainly introduces the international treaty, some developed countries such as the United States, Britain, Germany, and the relevant provisions of China's reasonable the use of the system to the network environment. In the fourth chapter, perfecting the system of fair use in network environment in China from the legislative model and network times together Some suggestions are put forward from two aspects of using the system of the new development.
