我国个人信息隐私权保护法律存在的问题及思考——以与互联网企业利益平衡为视角

【摘要】：随着科技和网络的发展,个人隐私权遭到前所未有的冲击,与之相应,传统隐私权也发展到信息隐私权,强调个人对自身信息的积极控制。在对个人信息隐私的诸多威胁中,基于逐利的动因,来自互联网企业的威胁尤为突出。由于我国现行法规对个人信息权利保护不周,如个人信息保护法规位阶偏低,法院对互联网企业的倾向性保护较为明显等,建议在民法加强对人格权保护的基础上,尽早制定专门的《个人信息保护法》,充分保障网络用户以信息控制为中心的信息隐私权,通过重新界定信息隐私侵权行为和损害后果、强化处罚力度等措施,为个人信息隐私权提供周全保护。
[Abstract]:With the development of science and technology and the network, the personal privacy right is under unprecedented impact. Accordingly, the traditional privacy right also develops to the information privacy right, emphasizing the individual's active control over his own information.Among the threats to the privacy of personal information, the threat from Internet enterprises is especially prominent because of the motive of profit-seeking.Due to the inadequate protection of personal information rights in the current laws and regulations of our country, such as the low rank of personal information protection laws and the obvious preferential protection of Internet enterprises by the courts, it is suggested that the civil law should strengthen the protection of personal rights on the basis of the civil law.To formulate a special personal Information Protection Law as soon as possible, to fully protect the information privacy rights of network users centered on information control, and to strengthen penalties by redefining the infringing acts of information privacy and the consequences of damage, and so on.To provide comprehensive protection for the right to privacy of personal information.
